SABAH 20 POINTS/ SARAWAK 18 POINTS AGREEMENT WHEN JOINING MALAYA

Point 1: Religion

While there was no objection to Islam being the national religion of Malaysia there should be no State religion in Borneo (Sarawak & Sabah), and the provisions relating to Islam in the present Constitution of Malaya should not apply to Borneo.

Point 2: Language

* a. Malay should be the national language of the Federation

* b. English should continue to be used for a period of 10 years after Malaysia Day

* c. English should be an official language of Borneo (Sarawak & Sabah) for all purposes, State or Federal, without limitation of time.

Point 3: Constitution

Whilst accepting that the present Constitution of the Federation of Malaya should form the basis of the Constitution of Malaysia, the Constitution of Malaysia should be a completely new document drafted and agreed in the light of a free association of states and should not be a series of amendments to a Constitution drafted and agreed by different states in totally different circumstances. A new Constitution for Borneo (Sarawak & Sabah) was of course essential.

Point 4: Head of Federation

The Head of State in Borneo (Sarawak & Sabah) should not be eligible for election as Head of the Federation

Point 5: Name of Federation

"Malaysia" but not "Melayu Raya"

Point 6: Immigration

Control over immigration into any part of Malaysia from outside should rest with the Central Government but entry into Borneo (Sarawak & Sabah) should also require the approval of the State Government. The Federal Government should not be able to veto the entry of persons into Borneo (Sarawak & Sabah) for State Government purposes except on strictly security grounds. Borneo (Sarawak & Sabah) should have unfettered control over the movements of persons other than those in Federal Government employ from other parts of Malaysia Borneo (Sarawak & Sabah).

Point 7: Right of Secession

There should be no right to secede from the Federation

Point 8: Borneanisation

Borneanisation of the public service should proceed as quickly as possible.

Point 9: British Officers

Every effort should be made to encourage British Officers to remain in the public service until their places can be taken by suitably qualified people from Borneo (Sarawak & Sabah)

Point 10: Citizenship

The recommendation in paragraph 148(k) of the Report of the Cobbold Commission should govern the citizenship rights in the Federation of Borneo (Sarawak & Sabah) subject to the following amendments:

* a) sub-paragraph (i) should not contain the proviso as to five years residence

* b) in order to tie up with our law, sub-paragraph (ii)(a) should read "7 out of 10 years" instead of "8 out of 10 years"

* c) sub-paragraph (iii) should not contain any restriction tied to the citizenship of parents – a person born in Borneo (Sarawak & Sabah) after Malaysia must be federal citizen.

Point 11: Tariffs and Finance

Borneo (Sarawak & Sabah) should retain control of its own finance, development and tariff, and should have the right to work up its own taxation and to raise loans on its own credit.

Point 12: Special position of indigenous races

In principle, the indigenous races of Borneo (Sarawak & Sabah) should enjoy special rights analogous to those enjoyed by Malays in Malaya, but the present Malays' formula in this regard is not necessarily applicable in Borneo(Sarawak & Sabah)

Point 13: State Government

* a) the Prime Minister should be elected by unofficial members of Legislative Council

* b) There should be a proper Ministerial system in Borneo (Sarawak & Sabah)

Point 14: Transitional period

This should be seven years and during such period legislative power must be left with the State of Borneo (Sarawak & Sabah) by the Constitution and not be merely delegated to the State Government by the Federal Government

Point 15: Education

The existing educational system of Borneo (Sarawak & Sabah) should be maintained and for this reason it should be under state control

Point 16: Constitutional safeguards

No amendment modification or withdrawal of any special safeguard granted to Borneo (Sarawak & Sabah) should be made by the Central Government without the positive concurrence of the Government of the State of North Borneo

The power of amending the Constitution of the State of Borneo (Sarawak & Sabah) shouldbelong exclusively to the people in the state. (Note: The United Party, The Democratic Party and the Pasok Momogun Party considered that a three-fourth majority would be required in order to effect any amendment to the Federal and State Constitutions whereas the UNKO and USNO considered a two-thirds majority would be sufficient)

Point 17: Representation in Federal Parliament

This should take account not only of the population of Borneo (Sarawak & Sabah) but also of its seize and potentialities and in any case should not be less than that of Singapore

Point 18: Name of Head of State

Yang di-Pertua Negara

Point 19: Name of State

Sarawak or Sabah

Point 20: Land, Forests, Local Government, etc.

The provisions in the Constitution of the Federation in respect of the powers of the National Land Council should not apply in Borneo (Sarawak & Sabah). Likewise, the National Council for Local Government should not apply in Borneo (Sarawak & Sabah).

KUALA LUMPUR: The incident in Sarawak's Senadin constituency involving
PKR candidate Dr Michael Teo will be presented to the United Nations
Human Rights Commission in Geneva today.
The disputed results on April 16 will form the spine of a presentation
to be made by Sarawak Report (SR) and other observers of the recently
concluded 10th Sarawak election.
According to SR blogger Clare Rewcastle Brown, "we will tell exactly
what happened (in Sarawak)".
Citing Senadin, she said PKR was leading by 1,000 odd-votes during the
last ballot counting in Miri City Stadium when suddenly a blackout
"conveniently occurred".
The blackout, she said, lasted an hour during which time the Election
Commission (EC) continued counting.
"Suddenly they brought in 'postal' votes at an illegally late hour and
SUPP was declared 'winners' with a slim 58-vote majority.
"The EC also announced 158 spoiled votes favouring PKR. The commission
refused a recount despite the fact that there was a clear case for
it," she said.
Brown added that the Senadin incident was only one example that SR was
planning to present to the UN.
She said SR's report to the UN would include the "mass
disenfranchisement of much of the population in the interior".
This, she said, enabled Taib to operate a "rotten borough system"
where seats are decided by just a tiny number of people whom he can
pressure and influence.
"Some 470,000 natives do not voting rights out of Sarawak's 2.5
million population.
"There is also the illegal touting of projects and votes by Barisan
Nasional politicians, including the prime minister, in the run-up to
the election.
"These are used as a direct bribe and form of blackmail. They tell the
voters that they will not get the projects and worse, may be
discriminated against in the provision of basic amenities if they do
not vote BN, " she said in her posting on SR.
Postal votes and bribery
On postal votes, she said this was another issue which would be made
known to the UN.
She said SR would inform the UN about the abuse of postal votes and
the "outrageous targeting of postal votes at single constituencies" BN
wants to influence.
"We will also tell them about the practice of doubling up by sending
in postal votes by the army and then bringing in plane loads of the
same soldiers to vote in person as well and the introduction of
suspicious last-minute 'postal votes' in order to try and boost BN's
tallies far later than legally allowed."
The other areas that the report will highlihgt include the use of
gangsters to intimidate and turn away voters from the polling
stations, the abuses by the EC which included switching voters'
polling stations away from their home areas to distant places they
cannot get to and hiding ballot boxes.
The UN will also hear of the tampering of Form 14, cutting off mobile
phone networks on polling day as well as the "naked bribery by BN" of
poor voters on the eve of the election.
Brown said the scale of these bribes went sky high at this election
and was indicative of how unpopular BN is.
BN secured 55 seats against the opposition's 16 in the April 16 polls.

COMMENTS:

This is not a strange news at all. Could UN do something about money
politics in Malaysia??? There is lawlessness when comes to election
campaign period.

COMMENTS:

BN has in fact failed badly to win with greater popular votes. BN wins poll in Sarawak but Pakatan Opposition Front has denied BN 2/3 of the popular votes; down by 8% from 63% to 55%. The Change has begun!

BN leaders have made racist remarks that Chinese voters have not supported the government. This is an unfair statement and a racist remark as the "urban voters" have supported the ideology for change in government since the reformation strategy by BN government has failed to produce much positive results. It should be categorized as "urban voters" and cannot racially pin-pointed to the Chinese because the low 55% of the total votes does not come from the urban only.

Judging from the low percentage of 55% of the overall votes, not only the urban voters have swung towards the Opposition but the rural voters have started to tilt towards the Opposition too. This is the scenario which BN govt cannot deny but have to look into it positively and re-evaluate the unfair and unjust policies which YB George Chan had admitted is one of the causes of SUPP defeat in the recent State Election.

Malaysian ex-PM Mahathir made a racist remark on the Chinese voters rather than categorized as urban voters versus rural voters who are still under the spell of poverty and still depend heavily on pro-govt TV news for brain-washing them. If the Opposition could have the mass-media and the fair game of the field, BN will lost more terribly and less than 55% of the total votes.

"Former premier Dr Mahathir Mohamad has accused DAP, which won 12 of the 15 seats it contested in Sarawak, of spreading its racist disease to the State. In a blog posting, the 84-year-old statesman said Saturday's state election results clearly showed that the Chinese in Sarawak rejected multi-racialism. "I congratulate DAP for bringing its racist politics to Sarawak. Before this, all races cooperated well with each other for the good of Sarawak. "Perhaps SUPP is at fault but others in BN also committed many wrong things. But the rejection is almost entirely by the Chinese community," he added.

With due respect Dr Mahathir Mohamad was not on the ground in Sarawak to witness the fraud and bullies committed by BN campaign machinery. The swing of votes came from both the urban voters and rural voters whose Native Customary Rights land have been robbed by the State government. The natural resources in the State is near depletion and soil erosion into the Rejang River has caused rampant flash floods in Sibu town and low-lying areas.

It cannot be denied that rural voters have swung to the Opposition lest the 12 urban and semi-urban seats could not contribute to 45% of the total votes supported by the People. In order to have 2/3 overall support from the voters, you need to achieve 67% of the total votes cast by the People of Sarawak from the 71 constituencies. Instead of pointing the blame on the Chinese voters why not re-look at the unfair and unjust policies which BN lawmakers have passed? Even SUPP Chairman George Chan had revealed the root cause as "unfair and unjust government policies". Why not blame on these unfair policies???

The urban voters have given SUPP over 30 years to represent the People and we have voiced out our frustration over Al-Kitab-Allah issue which needs a permanent solution to it and not quick-fit by 10-point proposal which has not even addressed the root cause of the issue coming from the Arabic word "Allah" which the Christians have used it centuries before the coming of Isalm to mean merely a title for "God" who has the personal Name called Yahweh (YHWH). Yet why the court's case agains the Roman Catholic Church in Malaysia is not settled yet???

Why the rural voters are still under the spell of poverty??? These rural voters have remained poor so that they rely on Federal govt aid and financial support. So the rural voters are desperate to find some source of extra incomes for the family. Every 5 year when comes the State Election, the BN leaders are willing to offer "money-for-vote" in order to remain in power. This is the real scenario of Sarawak politics. Poverty is the "master" who causes the rural folks to rely on Federal govt for financial aid.

The question is why Sarawak leaders have agreed to contribute 95% of the revenue to the Federal govt and only retain 5% for the development projects and not the other way of retaining 95% for the developments in the State. This again is because the Federal govt has "cheated" on the immature Sarawakian leaders who could be offered personal benefits at the expenses of the people who trusted them. Could BN govt develop fair and just policies on 50%-50% power-sharing basis??? Do not ever make racist remark on the Chinese alone because the root cause is not the Chinese but the BN govt who has instigated the Chinese to react with their votes.

The very purpose of democracy is to allow the People to express the wishes of the People by casting the ballots. Now the urban voters have "spoken" through their votes with "one-heart" and you begin to condemn the urban voters for this and that. I would say that BN leaders and ex-PM Mahathir are not so bright people who want to promote a real 1Malaysia but merely a slogan for show off - "hot air" only. The democratic rights of the People cannot be hidden from the eyes of the BN govt by apple-polishing State Assembly men and women. Voting is the democratic rights of the People and the People's rights cannot be punished for voicing their grievances. You cannot ignore the root cause of the displeasure and frustrations of the urban voters who have brains and courage to vote with "one-heart" in order to send a loud and clear message to BN govt that the People's wishes have been neglected.

How could you ex-PM misinterpret the outcome of Sarawak poll as the works of DAP from West Malaysia??? Why are you ignoring the PM and DPM who came to Sarawak like Santa Claus using Federal funds and vehicles for this campaign against the Opposition??? With due respect, ex-PM Mahathir has made a racist remark on the Chinese who have given a good feedback from the votes. Do you still want to ignore the wishes of the urban voters??? Wait and see the result for the coming Federal election in 2012 and you will know what the People really want!

Bawang Assan Seat won by BN Candidate may be challenged

DAP Chairman is aware of this "money for vote" during the election campaign. So are you DAP doing anything to avoid recurrence??? The key YB who is behind the suspension for DAP Chairman from State Assembly in 2009 for 12 months on "camouflage" remark is none other than BN-SUPP YB. It is not a matter of unforgiveness but a matter of justice as he used dirty tactics. God could have mandated you to challenge this election result for Bawang Assan and many other issues, by your huge majority this time. Are you capable to voice the issue out in the State Assembly and condemn this dirty tactic right in his face?

Reference on DAP Chairman's suspension as elected representative by the People should not be suspended by the decision of a biased few. Can you call it a democratic process when the majority voters is 4751 votes in 2006 (swelled to 8827 votes in 2011) and the Privileges Committee may be less than 30 persons. So where is the logic of democratic process to suspend an elected rep with the backing of strong majority??

DAP Sarawak assemblyman suspended for 'camouflage' remark
May 14, 2009

KUCHING, May 13 – The Sarawak Legislative Assembly has suspended Bukit Assek assemblyman and Sarawak DAP chairman Wong Ho Leng for 12 months effective immediately for his "camouflage" remark in the November State Legislative Assembly sitting last year.

Speaker Datuk Seri Mohamad Asfia Awang Nassar said Ho Leng, the opposition leader was suspended under Section 14 (1) of the State Legislative Assembly (Privileges & Powers) Ordinance 2007, based on the recommendation made by the Committee of Privileges.

Land Development Minister Datuk Seri Dr James Masing tabled the motion while Tarat assemblyman Roland Sagah seconded. All 60 Barisan Nasional (BN) assemblymen voted in favour of Ho Leng's suspension while seven others voted against it.

"Member for Bukit Assek, you are hereby suspended from today for a period of 12 months. Please leave the Dewan," he said.

Ho Leng walked out from the hall with two DAP state assemblywoman Violet Yong (Pending) and Ting Tze Hui (Meradong) at 6.10pm.

Ho Leng, who was met outside the State Legislative Assembly building, said the suspension was very "undemocratic and very unfortunate".

"We will consider legal action," he said.

The ruling meant that Ho Leng will be barred from attending the DUN sitting until May next year but during the suspension period he would still receive his salary and allowances as state elected representative.

Contacted by Bernama, Ho Leng confirmed that he still received his salary and allowances as the ruling only disallowed him from attending the sitting.

In the November assembly sitting last year, Ho Leng used the word "camouflage" repeatedly when debating and seeking clarification from the Second Finance Minister Datuk Seri Wong Soon Koh during the tabling of the Supplementary (2008) Bill 2008.

The Supplementary Supply (2008) Bill, 2008 involved an amount of RM921 million. Under the Bill, RM900 million was allocated for the Statutory Fund while RM21 was million being spent on the Employees' Provident Fund (EPF) bonus.

Asfia, the chairman of the Committee Privileges whose other members are Deputy Chief Minister Tan Sri Dr George Chan, Land Development Minister, Datuk Seri James Masing, Assistant Minister of Infrastructure Development and Communication Lee Kim Shin and Tarat assemblyman Roland Sagah. - Bernama

PKR declares victory for Pakatan in Sarawak

KUCHING, April 16 — PKR declared victory for Pakatan Rakyat (PR) tonight despite suffering massive losses, claiming the polls results were an "excellent start" to a new beginning for Sarawak and a sign that Malaysians were ready for a two-party system.

PKR's Sarawak chief Baru Bian, who won in Ba'Kelalan seat, said the pact's success in more than doubling its seat representation in the state assembly was a sign that Barisan Nasional's (BN) "fixed deposit" of Sarawak was now "being withdrawn."

"I would like to give thanks to the many people who prayed for us. The whole country was praying for a change and it has come ... it is a sign, it is an excellent start and a new beginning for change in Sarawak," he told a press conference at the party's headquarters here.

Tonight's results saw DAP scoring a resounding victory when it swept up 12 of the 15 seats it had contested while PKR won in three out of 49 seats and PAS lost in all five seats.

In total, BN retained its two-thirds majority but with a reduced tally from 63 to 55. Independent George Lagong won in one seat.

Sarawak-based opposition party SNAP, which fielded candidates to contest against PKR in 26 seats after a disagreement over seat distribution, failed to win a single seat and many of its candidates have even lost their deposits for the polls.

"From the results, one of the most obvious and good things is that it confirmed to us that the two-party system, that rose from the 2008 tsunami, is here to stay. It is a reality, judging from the vote pattern.

"It looks like the clear choice for the people is either BN or PR … this is a good sign of approval from Sarawakians that the system is here to stay," he said.

Despite its failure to deny BN its customary two-thirds majority in the House, the opposition nearly doubled its tally from eight to 15, a clear indication that PR had successfully broken into the ruling government's east Malaysian fortress.

PKR president Datin Seri Dr Wan Azizah Wan Ismail, who jointly chaired the press conference tonight, agreed with Baru's reading of the poll results, saying that Sarawakians had displayed political maturity throughout the 10-day campaign period and when casting their ballots today.

"I would like to congratulate Sarawak. The results are historic ... never in the history of Sarawak and this leads us to the two-party system," she said.

She also acknowledged that PKR had suffered major losses in the polls as it had only triumphed in three of the 49 seats it had contested but blamed the losses on electoral fraud.

"We were facing a government machinery so I thank Allah that we have done pretty well in the election.

"We were not faced with an ordinary or level playing field so now we want to see where these irregularities are and we will make our protest known," she said.

Both Baru and Wan Azizah agreed that tonight's outcome would boost PR's confidence in the coming federal elections, which has to be called before 2013.

Baru noted, however, that the voting pattern from the polls showed that many of those living in the interiors of Sarawak were still starry-eyed over BN's promises of development and election goodies.

The urban and semi-urban vote played a major factor in PR's success in tonight's state polls, a clear indication that the pact has yet to make significant headway with rural communities, often considered as BN's vote bank.

"There is a change ... but there is still a percentage of people in the rural areas who are yet to be ready to look into the future. Their judgements are clouded by how BN dangles carrots and projects before them," he said.

He promised, however, that PR would compile a list of BN's many promises made during the polls and hold them to it.

"We will expose them. I am confident that if we put the facts and truth before the people, their mindset will change," he said.

COMMENTS:

Congratulations to BN for retaining 55 seats and to Pakatan Rakyat for the astounding victory for increasing to 15 seats: PKR 3 & DAP 12. While the Independent won the Pelagus seat. The shift of the voting pattern basically came from the urban towns and cities while the rural areas are still bound by the "spell" of poverty. The spell is not yet broken by prayers for the rural people and more intensive prayers have to be made for them in the years to come. It may be another 15 years or 30 years before the younger educated generations will be able to take over their fathers' place.

The key issue which the Christians in Sarawak prayed for the change is the freedom of worship and freedom of expression to use any word which Yahweh Alaha has bestowed to the Christians since the day of Pentecost which marks the beginning of the era of the Christian Church in Jerusalem. Arabs Christians have used the word "Allah" which is a borrowed word from the Aramaic Christians who used "Alaha" for "The God"; "a" is the article in Aramaic for "the" and "alah" means "God". Alaha is not the name of God but merely a title for the Supreme Deity, the Creator.

Sarawak Christians have prayed for the permanent solution to AlKitab-Allah issue because the younger generations need Al-Kitab for Bible Study and for them to grow spiritually. Children today are taught in Bahasa Malaysia the national language of the country. Hence the children can read Al-Kitab in Bahasa Malaysia much better than in the local dialects of the different tribes. This time DAP has won 12 seats because the "spell" of poverty has been broken for the Chinese and the curse of poverty will not cast any fears on the Chinese Christians because the Name of Yahshua aka Jesus and the precious Blood of Yahshua have delivered them from the spell and curse.

What the elected representatives of the State Government have to do is mutual co-operation to eradicate poverty in the State and restore the freedom of worship. This Al-Kitab will remain as an issue for the next election and Federal election in the near future. The seed of change has been sowed and the urban people has retained the heat of change. It will remain for a long time until the basic rights as enshrined in the Constitution have been restored and honoured by the Federal government and State government.

I am writing this from outside Sarawak as I migrated with my family to Australia last year. I spent most of my working life in Miri and Kuching and as a businessmen, was forced to socialise with SUPP and other political leaders. I got to be quite close to them, and became one of their "supporters who was "required to "help during elections. I would like to appeal to all the voters, especially the Chinese voters, to vote for the opposition and not the SUPP. Let give just relate some of the home truths about SUPP

1. SUPP under George Chan is not working for the Chinese but Taib Mahmud. Forget the words but look at the action. TM took away the Kuching Mayor's post and gave it to a civil servant (died) without consulting SUPP. Before the announcement I was at a dinner with George Chan, Lee Kim Shim and Alan Sim and GC hinted that AS would make an excellent mayor for Kuching. AS was smiling so hard that you would have guessed that he was 100% sure that he would be the mayor. But TM simply gave it to someone else and GC could not do anything about it.

2. When the 2006 state elections came about, I was asked to "donate to SUPP campaign in Kuching. My Miri branch manager told me that the SUPP Miri people (Andy Chia, Datuk Wee and gang) "asked?for my company vehicles to be "loan them for the campaign. When the issue of land lease came up, GC told us in a dinner function that he will "speak to CM and CM would make an announcement at a unity dinner in Kuching. I was forced to buy 3 tables at this dinner at Crowne Plaza. I was sitting a metre table away from the VIP table and I saw GC begging the CM to announce that he would renew the lease. CM just told GC, in front of everyone, I will announce in my own time. Can you image the SUPP president's shame? In front of the Chinese community, he cannot even get the CM to make a "hint about the land lease.

After the elections, I was having dinner with GC's supporters in Miri and he told in a serious tone that CM refused to make the announcement because he wanted to "punish the Chinese/SUPP for making "too much noise". This meant that TM had already destroyed Iban unity by splitting PRS/PBDS into two factions and he wanted the Chinese to be
the same while he prepared his children to come in and take over. This man even hinted that TM only dared to do this because GC was the SUPP president. GC cannot stand up to TM on any issue. He just gives in on every crucial issue. Why?- I will tell you later.

3. During the 2006 state elections, one of SUPP's biggest financial contributors, Ting Chek Si, a tycoon from Sibu, was not selected to defend his Meradong seat. His crime? TCS was in a business dispute with TM's brother over the Sanyan group of companies. TCS has sued TM's brother for "oppression?and revealed that he gave TM's brother 51% of the shares in the company in return for TM's timber concessions. TM told George Chan to dump TCS and GC, like a good running dog, did as he was told. This is despite the fact that Meradong people wanted TCS because he was using his won money to provide help to Meradong. The SUPP Central working committee even endorsed TCS's name as candidate. What kind of party leader is George if he dumped his own men and listen to PBB"s leader? Is SUPP a sub-branch of PBB?

What is worse- when TCS protested to GC, GC lied to his face straight and told him to keep quiet and TCS will be given another chance as senator. Of course GC did not keep his promise, he gave the senatorship to Sim Kheng Hui.

4. This is not the first time GC lied openly to his colleagues. In 2004 General Elections, he promised Law Heing Ding that he will be nominated as the Minister but for the last term. George even put this in writing. After the elections, George nominated Datuk Peter Chin. Is it any wonder that LHD called George Chan a liar in the Chinese press and GC did not dare to sue him? If George Chan is a man of honour as he says he is, why does he not sue LHD for defamation?. LHD even went to the extent of writing a complaint letter to all the SUPP CWC members and gave a copy to the PM and TM. He has documents to prove that GC is lying and backstabbed him.

5. You do not need to look at GC's political games to know he is a fake. Just look at the way he behaves towards his first wife, Judy. He cheated on for some many years that she ran away. He had an open affair with Christina Foo of Priority One and gave the company a lot of state government consultancies. During the search and rescue mission for Dr Judson in the Kelabit highlands, he visited the place often to "direct?the search. The real reason was that he was chasing a Kelabit girl and took her to KL to be his mistress. Just ask anyone in the highlands and they will confirm this story. This girl is now driving a BMW and living in a semi-D in KL. What kind of man would use a moment of anguish over a helicopter crash
to think about sex and chasing girls. Is this a "leader of the Sarawak Chinese community?

Even worse, he allowed his daughter (the most beautiful one with white skin) to marry TM's son. When Sulaiman turned out to be playboy and started to hit the daughter, GC actually told the daughter to "bear it as Sulaiman could ensure that she has a luxurious life. When Sulaiman heard this, he hit the poor daughter even harder and send her off to live in the states leaving him free to chase all sorts of girls in KL and Manila. As a father, how could GC do all these things?

The question is why? Why does GC do all these underhanded things? The answer is simple. The love of power and wealth. He can only get power and wealth by being a running dog to TM and this is exactly what he has done. He has made SUPP weak because TM wants SUPP to be weak while the Melanau dynasty rules forever.

George Chan wants to enjoy the good things in life like fine wine (he has one of the finest wine collections in Malaysia) and women. He can only do this as deputy CM. With a leader like George Chan, who lies to his own senior party members, and reports to PBB and TM- can we elect SUPP? If SUPP were to come out and say that it is a sub-branch of PBB, at least I will consider it as they will be telling the truth for the first time. After all these nonsense I decided that I had better migrate. I do not want my children to deal with this sort of "leaders and live in a country where the Chinese leaders are forever kowtowing to someone else.

I am not writing this out of spite. I encourage readers in Sarawak and elsewhere to investigate if what I say here is true. Even if 50% is true, don't you think SUPP deserves to be punished?

The only way to get rid of George Chan and his group of "PBB/SUPP members is to vote out SUPP until George Chan loses power. There is no other way. I took the easy way out by migrating but that does not mean I do not love Sarawak or care for the future of Sarawak. It simply means I am too old. I am telling his story so that the younger generation will know the truth.

SUPP WONG SOON KOH had been heard to abuse the powers of the Privilege Committee as he was heading it to suspend DAP Wong Hoe Leng for 12 months in 2009 on the neutral word "camouflage" when it is used to imply if it has other hidden expenses not shown in the account. It has no insulting undertone but he played around the word. The People elected him to be representative for Sibu and he was paid to speak for the People. By the abuse of powers of this SUPP Wong Soon Koh and BN, DAP Wong Ho Leng was denied of his rights as State Assemblyman to speak for the Sibu People for a long 12 consecutive months. This is an undemocratic act which must be abolished to avoid abuse of powers.

The suspension of DAP State Assembly woman TING TZE HUI is another display of abuse of powers by SUPP-BN State Govt.

Ting suspended for rest of current session for misleading the DUN on May 21 sitting

KUCHING: Meradong assemblywoman, Ting Tze Hui, was suspended for the rest of the current State Legislative Assembly sitting after the Committee of Privileges found her guilty of misleading the house.

When the members were asked to cast their votes 53 supported the motion to suspend her while five were against.

After her suspension was announced by Speaker Mohd Asfia Awang Nassar, she left the chamber accompanied by her colleagues and Sarawak DAP chairman and Bukit Assek assemblyman Wong Ho Leng, Kidurong assemblyman Chew Chiu Sing and Pending assemblywoman Violet Yong.

She was referred to the committee after she uttered misleading remarks on the state government's spending on 1st Silicon last May 21 sitting.

Ting was subsequently called to defend herself before the committee last June 30.

The committee comprised Asfia, Deputy Chief Minister Datuk Patinggi Tan Sri Alfred Jabu Numpang, Second Minister of Planning and Resource Management Datuk Amar Awang Tengah Ali Hassan, Assistant Minister of Communication Datuk Lee Kim Shin, Muara Tuang assemblyman Datuk Seri Mohd Ali Mahmud and Tarat assemblyman Roland Sagah Wee Inn.

The motion to suspend Ting was read by Land Development Minister Dato Sri Dr James Masing.

When asked by Asfia to make her final plea, Ting described her predicament as "like an inmate ready to be executed".

Ting later urged the Barisan Nasional backbenchers to give her the last chance to say something before "she would be executed".

An argument ensued between her and the backbenchers before she finally let Wong defend her.

As Wong stood up, he was booed by the backbenchers for saying that the house was no longer practising democracy.

At one point, when Jabu interject, Wong asked him, "Who are you?"

Jabu replied, "I am your political enemy".

Ting, Wong and Yong also decided to boycott the rest of the proceedings yesterday.

Besides Ting, two other opposition members who are currently suspended are Chong Chieng Jen (DAP-Kota Sentosa) and Dominique Ng (PKR-Pandungan).

So unless Moslem can prove that Khadija did not bring Muhammad to consult and learn from Bishop Waraqa about Allah and Gabriel by 4 eye-witnesses vide Quran Sura 24:13, there is nothing to refrain the Christians from the use of Allah but have to proclaim that Allaha come from prior learning from Christian Bishop Waraqa instead.

Dear Heavenly Father, Yah'weh Alaha, the Creator of the Universe, in the name of your Holy Son Yah'shua, I bring the issue on the Sarawak State Election 2011 before your throne of Grace and righteousness. I ask for your forgiveness of all my sins which are committed by thoughts, words or deeds against your divine majesty. I plead the precious Blood of Yah'shua to cleanse me of all sins and unrighteousness. I plead the precious Blood of Yah'shua to cover myself from head to toes and to cover all my loved ones so that none of these demonic spirits could have power to cause any malice and harm.

By faith I put on the whole armour of Yah'weh Alaha so that the battle against Satan and his demons will not prevail against me and the Church. In the mighty Name of Yah'shua, I come against Satan and his hierarchy of darkness as stated in the Holy Bible.

Ephesian 6:12 For we wrestle not against flesh and blood, but
1. against principalities,
2. against powers,
3. against the rulers of the darkness of this world,
4. against spiritual wickedness in high places.

I plead the precious Blood of Yah'shua the Messiah shed on the Cross at Calvary to come in between the Bomoh spirits of Taib and the people of Balingian and Be'kelalan, breaking every curse and spell on the mind of the voters so that they can make the right choice on the candidate who can truly serve the people for many years ahead.

I come against the Satan the Devil and demons of hell which are invoked by the Bomohs to aid all the BN Politicians to be bound and gagged so that no aid can be rendered to them in any way. I implore Yah'weh Alaha the Almighty to help only those who deserve your help so that your will be done on earth as it is in Heaven. I pray against the powers of darkness which are invoked by the Bomoh Stella and other Bomohs of Taib to be bound and gagged so as to render them totally ineffective and accurate in their forecast and advices. May Yah'weh Alaha reverse all the curses from the Bomohs of Taib into blessings for the people of Sarawak. May the spell from these Bomohs be broken in the mighty Name of Yah'shua.

May the Spirit of Intercession goes with the Churches in Sarawak so that they may intercede for the voters in Sarawak, particularly the Christians candidates who have been chosen by the power on high to serve the people. I pray against all forms of money politics such as vote-buying, allocation of funds for the people during this election campaign to perish and bring no fruitful result in the mighty Name of Yah'shua.

I implore Yah'weh Alaha to help whosoever righteous candidates in this Sarawak State Election 2011 so that they may be elected democratically by the people without any influence of money and spell. I pray that those who play dirty politics, deception of any forms and liars will perish in this election. I pray for peace, good weather and a strong government to be formed to govern the State of Sarawak with integrity, corruption free, peace, prosperity, freedom of worship and usage of a title "Allah" be reinstated to the native Christians in Sarawak and for the Orang Asli in Malaya.

Christian Federation of Malaysia (CFM) remains unconvinced with the government’s 10-point solution to the Alkitab-Allah Row

PETALING JAYA, April 14 – The Christian Federation of Malaysia (CFM) remains unconvinced with the government's 10-point solution to the Alkitab row, calling it "ad hoc and short term" and pointing out that it still did not address the impasse over the use of the word "Allah".

The Najib administration had come up with the solution on April 11, ahead of elections in Sarawak, the state with the most number of Christians.

"We consider the 10-point solution to be an ad hoc and short term solution to the two consignments of Alkitab which have been impounded at Port Klang and Port of Kuching," CFM president Ng Moon Hing told reporters here.

Ng explained that while the 10-point solution had dealt with the impounding of the Alkitab, it had failed to address the root cause of Christian discontent – the prohibition of publications containing the word "Allah".

He then cited three laws which were the root cause of the "problem":

• The 1982 prohibition of Alkitab and 1983 prohibition of "Perjanjian Baru" under the Internal Security Act on the grounds that the Alkitab is prejudicial to national security interests of Malaysia;

• The 1986 administrative order prohibiting the use of the term "Allah" in Christian publications on the grounds of "public order" and prevention of misunderstanding betwen Muslims and Christians;

• The Home Ministry's guidelines of publications on the control of Quranic texts (Garis panduan bahagian kawalan dan penerbitan buku teks Al-Quran) prohibiting the use of Allah.

"The 1country 2 policies is confusing and unacceptable," said Ng today.

Faced with an unyielding Christian community days ahead of a crucial state poll in Sarawak, the government offered early this month a 10-point solution to the Alkitab impasse which will allow the Bible to be freely distributed across the country in all languages.

The Cabinet offered a new list of suggestions to put an end to the month-long stand-off over 35,000 Alkitab seized by the Home Ministry in a bid to head off a possible backlash against the ruling Barisan Nasional (BN) during Saturday's vote by Christians who make up half the population in Sarawak.

However, it insisted that Malay-language bibles in the peninsula be marked with a cross and "Christian Publication" on the front cover.

Prime Minister Datuk Seri Najib Razak also gave his assurance yesterday that his administration would never again impound bibles.

But Muslim groups and leaders have accused the government of capitulating to pressure from Christians and failing to uphold Islamic laws and dignity.

The Control and Restriction of the Propagation of Non-Islamic Religions Enactment bars non-Muslims from using Allah to refer to God as is done in the Alkitab.

The law applies in all states besides Sabah, Sarawak, Penang and the federal territories.

"We reiterate that the Bible is our holy scripture and it is our right to read study and pray with it in the language of our choice, as freedom of religion is enshrined under Federal Constitution," said Ng today.

He then referred to item 9 of the 10-point solution which "reiterates the government's commitment to address religious issues."

"The government should therefore take immediate steps to remove root causes by revoking clauses made under the ISA and the administrative order and to amend the garis panduan (guidelines) to remove the prohibition," the CFM chairman added.

Does "Allah" Mean God?

The word "Allah" is the perfect description of the "One God" of monotheism for Jews, Christians and Muslims!

Is "Allah" only for Islam and Muslims?
[No! It is for All Three Abrahamic Faiths.]

"Allah" is the same word used by Christian Arabs and Jewish Arabs in their Bible, centuries before Islam came.

For Arabic they have translated the verse in the New Testament in Arabic from the famous verse in the Gospel John 3:16 -

"For God so loved the world..."
- and the word the translators used in Arabic for "God" is the very same word used by Muslims around the planet, "Allah."
Where Does the word "Allah" Come From?

"Allah" comes from the Aramaic word "elah" for a 'god' or something worshipped. - (Arabic) means '

This word (elah) can be made plural (gods), as in "aleha" and it can be male or female just as the word in English can be "goddess."

"Allah" comes from "elaha" but it brings more clarification and understanding.

Allah = Has no gender (not male and not female)
"He" is used only out of respect and dignity - not for gender
Allah = Just a title for "God" and not a personal Name of God

Allah is the borrowed word from Aramaic "Alaha" aka Allaha.

The evidence of Surah 4:125 for Allaha: (Pickthal)
Who is better in religion than he who surrendereth his purpose to Allah while doing good (to men) and followeth the tradition of Abraham, the upright ? Allah (Himself) chose Abraham for friend.

For this orthographic substitution at least one case of an indirect evidence can be adduced. In surah 4:125 there are both grammatical and exegetical reasons to assume that the word "Allah" had better not been substituted for "Al-ilah". Richard Bell's interpretation of this verse, which follows the line of the traditional understanding, is:

A Who is better as regards religion than
B he who surrenders himself to Allah, doing good meanwhile,
C and follows the creed of Abraham as a Haneef?
D Allah took Abraham as a friend.

Did Alaha really told Abraham that His Name is "Allah" or it is merely a title like "Sir or Madam"? Is there any explicit verse which says "My Name is Allah"?

Alaha aka Elohim did introduce Himself that His Name is YHWH or Yahweh. So we known that Allah is just a title like "Sir" and not the personal Name of the Alaha of Moses.

Exodus 3:15 And Elohim said moreover unto Moses, Thus shalt thou say unto the children of Israel, YHWH Elohim of your fathers, the Elohim of Abraham, the Elohim of Isaac, and the Elohim of Jacob, hath sent me unto you: this is my name for ever, and this is my memorial unto all generations.

Isaiah 42:8 I am YHWH: that is My Name: and My Glory will I not give to another, neither my praise to graven images.

Genesis 12:1 Now YHWH had said unto Abram, Get thee out of thy country, and from thy kindred, and from thy father's house, unto a land that I will shew thee:

The personal Name of the Alaha of Abraham is called Yahweh and not Alaha which is merely a common title for all gods.

These verses says Allah's Name and what is that God's name???

Sura 5:4 (Pickthal) They ask thee (O Muhammad) what is made lawful for them. Say: (all) good things are made lawful for you. And those beasts and birds of prey which ye have trained as hounds are trained, ye teach them that which Allah taught you; so eat of that which they catch for you and mention Allah's name upon it, and observe your duty to Allah. Lo! Allah is swift to take account.

Sura 6:118 (Pickthal)

Eat of that over which the name of Allah hath been mentioned, if ye are believers in His revelations.

Sura 6:121 (Pickthal) And eat not of that whereon Allah's Name hath not been mentioned, for lo! it is abomination. Lo! the devils do inspire their minions to dispute with you. But if ye obey them, ye will be in truth idolaters.

Sura 7:180 (Pickthal) Allah's are the fairest Names. Invoke Him by them. And leave the company of those who blaspheme His Names. They will be requited what they do.

So what is Allah's Name and Allah's are the fairest Names in plural???

Sura 27:30 (Pickthal) Lo! it is from Solomon, and lo! it is: In the Name of Allah, the Beneficent, the Merciful

How could "God" which is merely a title be treated as the personal name of God? In the Name of God is meaningless. In the Name of Yahu'shua or In the Name of Yahu'weh Alaha only make sense.

Sura 59:24 (Pickthal) He is Allah, the Creator, the Shaper out of naught, the Fashioner. His are the most beautiful Names. All that is in the heavens and the earth glorifieth Him, and He is the Mighty, the Wise.

It does not make any sense that "God" is the beautiful Names if Allah means "God" to the Muslims??? But to Arabs Christians, "Allah" means not more than a title "God" or Elohim in Hebrew.

The proper usage of Alaha in Aramaic or Elohim in Hebrew is used after the Personal Name of Alaha.
Genesis 2:7 And YHWH Elohim formed man of the dust of the ground, and breathed into his nostrils the breath of life; and man became a living soul.

Christian Update - Sarawak State Election 2011

Dear Bro and Sister in Christ,

The atmosphere for this election is very, very different from the previous ones whereby many Sarawakians, Christians and non-Christians alike are more interested and placing extreme importance on finding their own rights as voters.

The awareness this time around are much more greater than ever. Ibans, Chinese, Melanau and many other races among the locals are now realizing that their land rights, religious freedom as well as wealth of their state has been long stolen by the corrupted leader.

Many are becoming aware that the Chief Minister of Sarawak has long stolen their wealth of the state. During the sharing over the phone, my dad is encouraging us to now target on one very important spiritual battle that we all need to pray for and that is the Bomoh or spiritual leaders that Chief Minister (BN) Taib Mahmud has hired over the years.

Every Thursday night, the bomohs would gather at selected cemetery to cast the spells and perform many rituals to not only charm the voters but also to blindfold the voters from their rights and freedom.

These bomohs are also his key advisors that help advise him on many key decisions including selecting his state leadership excos and ministers. Their main responsibilities are basically to use spiritual power to manipulate Sarawakians in ensuring victory for BN. As such, all the churches and Christians in the state right now are focusing on this issue as they pray for the election.

If you are a true Christian, pray for God's will be done on earth as it is in Heaven. The current State Government has failed to protect the basic rights of the native Christians in term of the freedom to use the Aramaic word "Elah" for "God" and Arabs Christians used Arabic "Allah" for Elah. Native Christians in Sarawak also used "Allah" as one of the titles for Yah'weh Alaha. Both Aramaic and Arabic scholars will agree that "Allah" have been used by Arabs centuries before the coming of Islam.

The native Christians in Sarawak cannot be denied to use Al-kitab with word of Allah in it. Imagine how do these native Christians be able to grow spiritually in the word of Allah if the local people is denied of the import of The Bible in Bahasa Malaysia which is the national language of the country? These 2 consignments of Al-Kitab have been confiscated and desecrated by unlawful stamping of serial numbers like criminal used in the jails. Allaha is the Aramaic word for "God". Al-ilah is the Arabic word for Allaha. El or Elohim is the Hebrew world for Allaha. The use of Allaha
or Elah for Elohim by the Jewish Christians such as Prophet Paul and Prophet Barnabas since 50AD. The native Arabs use Elah or Allah when
the Gospel of Yahu'shua was preached to them in Jerusalem around AD33. The historical events was recorded by Dr. Luke the disciple of
Yahu'shua as follows:

Anyone with a pair of good eyes can see from Acts 2:11 that Arabians
were there in Jerusalem around AD33 and heard the works of Elohim or
Elah aka Allah.

Arabs went to trade in Syria long before the advent of Islam in 610AD.
Based on tradition, Mohd was reported to have travelled to trade in
Syria at his age of 12 years in 582AD when the Nestorian Christians
were most powerful in Iraq and in Syria. Mohd was influenced by the
teaching of Christianity and the Bishop Waraqa bin Nawfal of the
Nestorian Church declared him as a messenger to the Arabs. Waraqa was
the cousin of Khadijah wife of Mohd. It is believed that Khadijah was
a Christian by the influence of Waraqa. The marriage of Khadijah and
Mohd was even solemnized by Bishop Waraqa. Khadijah taught Mohd for 9 years from 610AD till her death around 619AD.

Based on the historical records, Elah or Allah is the title of Yahuweh
(YHWH) used by Arabs Christians since AD33. So the claim by Malaysian
Moslem that Allah is exclusively for Islam is a baseless and illogical
assertion. In fact all Hebrew Prophets are exclusively for the seed
of ISAAC only as Sarah had advised Abraham to cast out Hagar and
Ishmael so as to deny Ishmael as the co-inheritor with ISAAC. Genesis
21:9-14 is the historical record about the event which took place
around 3000 B.C.

unto Abraham, mocking.

The act of casting out Ishmael was a total sever of co-inheritorship
with ISAAC. It means the firstborn rights of Ishmael was transferred
to ISAAC with effect from the day Ishmael was cast out. ISAAC's son
Jacob aka ISRAEL is still known today because of Yahu'weh Elah's
promise to Abraham and Isaac. So Moslem have no exclusive right to use
Allah but in fact infringe the rights of the Christians by
plagiarizing the Hebrew prophets and counted them as Moslem. Moslem
should erase all names of the Hebrew prophets from their book because
"in ISAAC thy seed shall be reckoned".

I challenge Moslem to bring 4 eye-witnesses in accordance with Quran
24:13 if any one of you want to refute that the Jews have altered the
Hebrew Tanakh or Bible. If any Moslem want to challenge the integrity
or accuracy of Acts Chapter 2 that Arabians have heard from the
Apostles of Yahu'shua who proclaimed to them about Elah or Allah and
Yahushua the Son of Yahuweh Elah, then produce 4 eye-witnesses who
lived at the time of the apostles of Yahu'shua and confirmed that
Pentecost event did not take place at all. Failing which Moslem have
to drop all nonsense claim on "Allah" usage and apologize to the
Christians for plagiarization.

All names of the Hebrew prophets are hereby demanded to be erased from
Moslem Book immediately until they show proof by 4 eye-witnesses that
Ishmael was not cast out of the family by Abraham. If Moslem cannot
refute the contract that Yahuweh Elah made with ISAAC and not with
Ishmael then there remain no rights to use the Hebrews names in their
book because Sarah had disallowed Ishmael and his offspring from
co-inheriting with ISAAC which obviously meant these prophets are the
exclusive rights of the Jews and Jewish Christians.

Today we hear about the Al-Kitab or Holy Bibles are confiscated at
Port Klang and Kuching due to the word of "Allah" being used in the
Holy Bible in Bahasa Malaysia(BM). Moslem accused Christians of
infringement of the word "Allah" and banned the BM Holy Bible and
confiscated 35,000 Al-Kitab. This act is most evil against Yahu'weh
Elah because He sent His Son Yahu'shua to proclaim that His Gospel is
meant for all races and for the whole world. Anyone who interfere with
the distribution of the Holy Bibles is waging the war against Yahuweh
Elah.

Pray that there is no recurrence of oppression by Moslem in
the land of Sarawak. Send the demons or spirits of Bomoh back to hell where
they belong in the Mighty Name of Yahu'shua aka Jesus, the Son of
Yahu'weh Elah. May the Glory of Yahu'weh Elah shine in the land of
Sarawak. May all Christians around the world pray for Christians in
Malaysia to be liberated from the oppression by the false elohim Satan

Moslem have to produce 4 eye-witnesses in accordance with Quran Sura 24:13 that Yahu'weh Elah had not approved Abraham to cast out Ishmael and Hagar from his family. If there are no 4 witnesses to challenge it, then the Torah record is accurate. A honourable woman needs 4 eye-witnesses to charge her of any offence such as adultery. A honourable Abraham and honourable wife Sarah who cast out IshmaeL and Hagar symbolized total severance of co-inheritorship of Ishmael with ISAAC. Christians around the world shall pray for all Hebrews prophets in the Quran to be removed unless they can prove by 4 eye-witnesses that Abraham did not cast out Ishmael from his family. By the law of Torah, Muslims should produce 2 or 3 eye-witnesses that Abraham did not cast out Ishmael of the family. Muslims must at least comply with the Torah on the minimum of 2 eye-witnesses in order to establish the truth of the matter in dispute. Christian group rejects Idris Jala's 10-point solution

In a lengthy 10-point statement, the Council of Churches of Malaysia (CCM) Youth did not mince its words in dismissing the 10-point solution offered by Minister in the Prime Minister's Department Idris Jala.

It said that the "quick-fix" proposal ignored the "the overt and covert manner which the government had discriminated against the Christian citizenry for close to 40 years".

The following is CCM Youth's press release expressing its views in response to the various statements issued by the Christian Federation of Malaysia (CFM), the National Evangelical Christian Fellowship (NECF), the 10-point solution as proposed by Minister in the Prime Minister's Department Idris Jala, and comments made in the media by the Home Minister Hishammuddin Hussein and various parties.

1. 10-point proposal only addressed the Al Kitab issue The 10-Point Proposal presumed that Christians were only concerned with the Al Kitab issue. That premise is incorrect.

The 10-Point Proposal distracted both the public and the church leaders from getting to the heart of the matter, that is, the concern over the overt and covert manner which the government had discriminated against the Christian citizenry for close to 40 years that had resulted in the gradual deterioration of basic rights of Christians to freely exercise their faith.

2. Restore full rights and full freedom enshrined in the federal constitution CCM Youth denounced deplorable accusations that Christians were not being "fair" or "reasonable" in resolving the Al Kitab matter. CCM Youth disclosed that the Malaysian government had unreasonably and unjustly acted in bad faith since the early 1970s to-date against the Christian community. Among some examples were:

Gradual erosion of the control of mission schools which included even the physical removal of words such as "Holy" and crosses from schools, even though the land, building and board of governors belonged to the church; Removing or disallowing "Christian Fellowships" from being recognised as societies in schools and universities; Harassing and transferring out Christian teachers found teaching Bible Knowledge, a legitimate examinable subject for the SPM; Gazetting the Al Kitab, the Bible in Bahasa Malaysia and Bahasa Indonesia, as a threat to national security under the Internal Security Act; Denying the use of the word 'Allah' for the Christian God, even though it had been used by indigenous groups way before independence, and being the only Muslim country in the world to do so despite wide Arab usage; Denying Christians land to operate churches or cemeteries. And the list goes on.

CCM Youth was saddened that Christians today were openly abused, harassed and provoked in the media and encouraged by the government, with all sorts of erroneous information being placed on official government websites put up as decrees; linking activities from Valentine's Day to 'poco-poco' to crosses on football jerseys, to Christian beliefs without so much as a dialogue or a clarification with the Christian community. So much so that even the Islamic government machinery, with nods from cabinet ministers, the Home Ministry and state governments, unashamedly encouraged over-zealous religious officers and Islamic-based NGOs, to propagate and sow seeds of hatred towards the Christian community. CCM Youth was informed that recently a group of students went for an excursion to the Kuala Lumpur City Hall, and were denied entry just because their uniform had a cross.

After so many years of racial-religious polarisation under the hands of government machinery, religious and racial bigotry is now blatantly practised and widely nurtured in government departments against Christians. CCM Youth believed that the 10-Point Proposal was superfluous as Christian citizens were not asking for anything extra, but for their basic constitutional rights, enshrined in the Federal Constitution, to be respected and honoured.

3. Christians' birthright to read, speak and write in the national language CCM Youth opined that it was ludicrous to deny Malaysian Christian citizens the right to use the country's national language for the purposes of exercising their faith.

On the one hand, non-Malay citizens are often criticised for their purported lack of loyalty when they did not speak Bahasa Malaysia, but when they did, like in this case in order to read the Bible, which they had been doing for generations, they were denied that right. CCM Youth reiterated that as citizens of this country, it was their God-given birthright, which "should not be given up, negotiated, traded away, nor 'sold for a bowl of pottage'", being simply rushed into just because Christian leaders were offered a "quick-fix" solution to the immediate problems that were originally created by unjust parties.

4. The 10-point proposal does not carry the weight of law CCM Youth decried attempts to create a 'band-aid' compromise solution that did not carry the weight of law. If the government were truly sincere, there would not be a need for a 10-Point Proposal. Insofar as this matter was concerned, all the government needed to do was to instruct the Home Ministry to drop its appeal on the 'Allah' issue, which the Catholic Church won on Dec 31, 2009 when it took the case to the High Court. This action would immediately lead to the withdrawal of the Allah and the Al Kitab from any further restrictions in the country. CCM Youth urged the government to uphold democratic principles and not play games by taking a round-about route that did not reflect their sincerity.

5. 10-point proposal sows disunity amongst Christians The 10-Point Proposal served only to promote disunity amongst Christians, playing to the ruling government's 'divide-and-rule' tune. CCM Youth questioned how it could be plausible for a 1Malaysia, yet a 2Bible and 3Rule solution? If at all, it only cemented CCM Youth's opinion that 1Malaysia had been nothing but political rhetoric.

If Christian leaders had agreed to this proposal, the Orang Asal of Sabah and Sarawak would have one rule; while believers in the peninsula, including the Orang Asli, would have another rule. Should Christians subject themselves to such confusion and be manipulated to accept such terms? Likewise, by agreeing to such terms now, would Christians then forfeit the right to resolve future outstanding matters beyond the Al Kitab issue?

6. No guarantee that pledges or assurances will be honoured Time and time again, the Christian community have been given assurances but only to be disappointed later on. CCM Youth urged church leaders to be wise, for what had been dressed as compromise could turn out to be an entrapment – "Even the elect were deceived, if that were possible." CCM Youth pointed out that they were well aware that there were many obstacles ahead, and they understood the "card game was in the hands" of the government.
Even if the federal government gave the impression of giving way, they could fall back on the state government machinery that would kick in and take that to another gear which involved harassing book stores, printers, forwarding agents, schools and so on, located in affected states.

7. The tipping point - today's decision will impact future generations CCM Youth urged church leaders to take their time and not to be in a hurry. It was imperative that they did not fail future generations, or act in a manner that could adversely undermine or enslave future generations from practising their faith freely. CCM Youth urged church leaders to remain faithful and to take as much time as they needed to ponder and to ask pertinent questions without compromising the faith.

Otherwise, future generations would return to remind past generations of leaders of "compromises" made today, or that the church leaders held silent when they could have spoken up, having restrained themselves from pursuing justice when they had the opportunity to do so. CCM Youth urged church leaders not to worry about having to come to a decision by the CFM's Biennial General Meeting on April 14, 2011, but to take ample time to pray and seek the Lord before coming to a decision. CCM Youth reminded church leaders that even the youths today were still learning the full extent of the rights that had been eroded to-date as events unfolded, and CCM Youth would endeavour to support church leaders to their best of abilities to recover that which was lost, and hand over full freedom to future generations as their legacy.

8. Are we speaking to the right party with the authority? With due respect to Senator Idris Jala, CCM Youth raised concerns that there were no assurances that he had the full weight of the cabinet behind him in this regard, given the underlying tones and lack of media support from cabinet ministers. Even the prime minister himself had been strangely silent. From remarks given by the home minister and various "shadow gatekeepers", there had been no assurance that the relevant ministries would honour any form of agreement. What remained consistent so far had been the consistency of the government's inconsistencies. The danger of flip-flops was not a probability, but a given. CCM Youth believed that this rush to force a solution was inadvertently linked to the outcome of the Sarawak elections and the potential impact from its Christian majority population.

CCM Youth observed that it was this careless 'short-term opportunistic' attitude of the government for political expediency that had made them wary of such overtures and advised church leaders to exercise greater caution under such circumstances. If the government were sincere in addressing the grievances of the Christian community, CCM Youth believed that nothing less than the coming together of a task force from the Prime Minister's Department, the Home Ministry, the attorney-general, the Education Ministry and all state governments and Islamic departments had to take place.

9. Sorry seems to be the hardest word CCM Youth pointed out that it was Idris Jala (centre) who apologised.

So far, no official statement of apology had been offered by any ministry, especially none was forthcoming from the home minister, the main protagonist who directed the stamping of the Bibles. The public ought to know that this entire episode of the desecration of the Christian's Holy Scriptures happened during the holy month of Lent which precedes and commemorates the Lord Jesus Christ's crucifixion and celebrates His resurrection. If an opportunity presented itself for reconciliation and restoration to properly right the grave wrong committed, CCM Youth would certainly offer forgiveness. Obviously, the situation had yet to present itself.

10. Christian cabinet ministers must take leadership CCM Youth noted that except for Idris Jala, many Christian cabinet ministers have kept silent. One cabinet minister even called Christians foolish for holding prayer rallies. CCM Youth challenged cabinet ministers to be faithful and to choose today whom they served - whether God or man. CCM Youth reiterated that they were not being unreasonable, audaciously demanding or stirring trouble. CCM Youth regretted that for a long time, the church had remained silent, having compromised when it should not have.

In good faith, church leaders had been drawn into endless unproductive closed-door meetings, given verbal promises and handshake agreements that never materialized. Unfortunately for the church, Christian goodwill had not been reciprocated, and closed door agreements never honoured. The recent desecration of the Al Kitab was the last straw. CCM Youth called upon all Christians today to rally firmly behind their Christian leaders as they worked towards a resolution for the community.

CCM Youth urged the Christian community to uphold their leaders in prayer more fervently. CCM Youth reiterated that they remained committed to nation-building and bringing about justice, peace and reconciliation for all Malaysians and migrants, and would stop at nothing to bring about change for the betterment of all peoples regardless of creed, race or religion, through proclaiming truth and bringing about justice and transformation to the nation.

So unless Moslem can prove that Khadija did not bring Mohd to consult and learn from Bishop Waraqa about Allah and Gabriel by 4 eye-witnesses, there is nothing to refrain the Christians from the use of Allah but have to proclaim that Allaha come from prior learning from Christian Bishop Waraqa instead.

Govt allows import and local printing of Bible in all languages

PETALING JAYA: The Bible can now be imported into the country in all languages including Bahasa Malaysia, Bahasa Indonesia and in the indigenous languages.

It can also be printed locally and there is no requirement for any stamp or serial number.

These are part of a 10-point solution developed by the Government after being in dialogue with Christian groups, said Minister in the Prime Minister's Department Datuk Seri Idris Jala.

He hoped the solution would be received positively by Christian groups.

Below is the full statement by Idris on the 10 points provided to the media.

The Government confirmed that it has been in dialogue with the Christian groups to look into their specific requests on the Bahasa Malaysia/Indonesia Bible and also other religious issues. Taking into account the polarity of views of the different religious groups, including the Muslims, the Government decided on a 10-point solution.

1. Bibles in all languages can be imported into the country, including Bahasa Malaysia/Indonesia.

2. These Bibles can also be printed locally in Peninsula Malaysia, Sabah and Sarawak. This is a new development which should be welcome by the Christian groups.

3. Bibles in indigenous languages of Sabah and Sarawak such as Iban, Kadazan-Dusun and Lun Bawang can also be printed locally and imported.

4. For Sabah and Sarawak, in recognition of the large Christian community in these states, there are no conditions attached to the importation and local printing of the Bibles in all languages, including Bahasa Malaysia/Indonesia and indigenous languages. There is no requirement for any stamp or serial number.

5. Taking into account the interest of the larger Muslim community, for Peninsula Malaysia, Bibles in Bahasa Malaysia/Indonesia, imported or printed, must have the words "Christian Publication" and the cross sign printed on the front covers.

6. In the spirit of 1Malaysia and recognising that many people travel between Sabah and Sarawak and Peninsula Malaysia, there should be no prohibitions and restrictions for people who bring along their bibles and christian materials on such travel.

7. A directive on the Bible has been issued by the Ketua Setiausaha (KSU) of the Home Ministry to ensure proper implementation of this cabinet decision. Failure to comply will subject the officers to disciplinary action under the General Orders. A comprehensive briefing by top officials, including the Attorney General (AG), will be given to all relevant civil servants to ensure good understanding and proper implementation of the directive.

8. For the impounded Bibles in Kuching, Gideon, the importer can collect all the 30,000 Bibles free of charge. We undertake to ensure the parties involved are reimbursed. The same offer remains available for the importer of the 5,100 Bibles in Port Klang, which have already been collected by the Bible Society Malaysia (BSM) last week.

9. Beyond the Bible issue, the Government wishes to reiterate its commitment to work with the Christian groups and all the different religious groups in order to address inter religious issues and work towards the fulfilment of all religious aspirations in accordance with the constitution, taking into account the other relevant laws of the country. In order to bring urgency to this work, the Prime Minister will meet the representatives of the Christian Federation of Malaysia (CFM) soon to discuss the way forward.

10. The Christian Ministers in the cabinet will meet on a regular basis with representatives of the various Christian groups in order to discuss their issues and work with the relevant Ministries and PM in order to resolve them.

Dato Sri Idris Jala said, "I hope this 10 point solution will be received positively by the Christian groups as being fair and reasonable. We have to look for a solution that deals with the Bible issues and also put a way forward to handle other issues raised by the Christian groups".

"I think the Bible issue is very unfortunate, and in the spirit of Lent, it is time for sacrifice, reconciliation and forgiveness.

"In our history as a young nation, we achieved a lot in a short period of time, but we have our shortcomings.

"The Government and our civil servants are not perfect as indeed all human beings are "beautifully imperfect" in the eyes of God.

"And for all our shortcomings in handling the Bible issue, I hope the Christians would find it in their hearts to forgive us.

"In my Church at SIBKL, we have been praying for a Christian revival to take place in our country. For all the hurt that exist as a result of our differences, I believe that we need healing, forgiveness and reconciliation in this country.

"The Bible says in Matthew 18: 21-22 " Then Peter came to Jesus and asked, "Lord, how many times shall I forgive my brother when he sins against me? Up to seven times?" Jesus answered, "I tell you, not seven times, but seventy-seven times".

While it is the duty of all Christians in the country to forgive the MY Government for being oppressive, it must be understood that the first step of reconciliation is to apologize or seek for forgiveness from the Creator of the Universe that what had been done to the Holy Bible was wrong such as stamping with serial number without prior consent from the Christian groups. Even the context of Jesus Christ speaking "I tell you, not seven times but seventy-seven times" Matt 18:22 refers to prior acknowledgment of wrongs before the next step of forgiveness can apply.

First of all, the MY Government have to apologize to the Christians communities i.e. to CONFESS and apologize that stamping without prior consent is wrong and arrogant without practicing the will of Yahweh God.

As men do not like to deface the holy books of another man's religion, so you must NOT deface the Holy Bible as well. That is what Jesus Christ taught in Matthew 7:12. So the interpretation for Matthew 18:21-22 must concur with Matthew 7:12.

Although the 10-point proposal is seemingly good, Christians may want the permanent agreement to be "cast in stone" so that the issue may not recur and the "Allah" court cases should be ruled in favour of the Christians. In Aramaic, the word "Allaha" means supreme being or God is merely a Title and not the Personal Name of the Hebrew God. The personal sacred Name of God is Yahweh. It is the different context of the usage of word "Allaha" which creates some misunderstanding.

CONCLUSION:

The sacred Name of God is called Yahweh, not Allaha which is merely one of the many tiles for Yahweh God. Other titles include El, Elohim, Adonai, El Shaddai and so on.

Catholic Bishop Dr Paul Tan Chee Ing has denounced as “insidious” and “evil” the imposition of two sets of rules - one for Sabah and Sarawak and the other for Peninsular Malaysia - with regard to the dissemination of the Malay Bible, Al-Kitab.

Minister in the Prime Minister Department, Idris Jala, had announced yesterday a formula for the resolution of the controversy over the impoundment since January of thousands of copies of the Al-Kitab in ports at Kuching and Port Klang.

The formula allows for the dissemination in Sabah and Sarawak without conditions of the Al-Kitab, but for Peninsula Malaysia, copies of the Al-Kitab have to be stamped with the cross and have the words 'Christian Publication' on them.

Speaking to Malaysiakini in his capacity as the titular head of the Melaka-Johor diocese, Bishop Paul Tan (above), who is also president of the Catholic Bishops' Conference of Malaysia, said:

“If the policy is one for Sabah and Sarawak and another for Peninsula Malaysia, this is tantamount to using the insidious tactic of 'divide and rule.' I adamantly condemn and reject such means.”

The Christian Federation of Malaysia, the umbrella body for 90 percent of the denominational congregations in Malaysia, is to meet soon to discuss the government's latest offer for the resolution of the controversy.

Some Christian groups appear to be leaning in favor of the government's latest offer while others are loath to accept the differentiation of the rules between the Borneo states and the peninsula.

“There should be one policy for the whole Christian population in the azlan two parts of the country,” said Bishop Paul Tan.

“You can put 'Christian Publication' on each copy since this is what was agreed to in 2005 by the CFM with the Abdullah Badawi administration.

“But there should be no differentiation between the rules for Sabah and Sarawak and the rules for Peninsular Malaysia,” insisted Bishop Paul Tan.

Bishop Paul Tan, a past president of the CFM, noted that the latest announcement by Idris Jala made no mention of the term 'Allah', the legitimacy of which use is being contested in the courts.

He said any decision by Christian groups on the government's latest offer must take due note of this uncertainty.

“It is better to stick by a practice already agreed to in 2005 than opt for changes that carry the prospect of being rendered moot by a pending decision of the courts,” he said.

'Above all, there must be no differentiation between the rule for Sabah and Sarawak and the one for the peninsula,” he emphasized.

COMMENTS:

I salute the outspoken Catholic Bishop Dr Paul Tan Chee Ing for taking the lead to denounce dual system for the Christians in the country 1MY. As there is only one Yahweh God, there must be only one rule for the Christians in the country. When there are 2 rules for East & West Malaysian Christians, then it is impartial and improper for 1Malaysia. It is just too obvious the dual sets of rules is a reflection of how the MY government is marginalizing the West Malaysian Christians when the population is small. Sarawak Christians have the powerful hold on the decision of the next State Government as about 50% of the population is concentrated in Sarawak.

Comment: A suicide note from Teoh Beng Hock after death for 2 months!

It's interesting to know that AG who made a confession that the suicide note purportedly from TBH who was dead for 2 months could "write" suicide note!!!

AG admitted that sling bag of TBH was initial searched and the note was not found. This was a proof that the "suicide note" was not originally there by the own admission of AG.

What happened 2 months later could be easily planted by any unknown person, most probably from the work of high profile cover-up as officials from MACC are blamed to be responsible for the death of the key witness.

Now the IO should be investigated for his poor work and must be fired for non-disclosure of the "personal note" to TBH's family. If it was genuine, it was a personal note and no one can conceal it from his family.

If it was a fake note, most probably so based on the weight of evidence that "According to the Investigation Officer it was not found when he first searched the deceased's sling bag after the incident." which is a proof that the suicide note does not exist after the death of TBH but being planted 2 months later.

Just review the nature of injuries of Teoh Beng Hock. Are these photos of a person who committed suicide?

Clues:
1) The shoe's base shows severe abrasion possibly caused from dragging
2) The trouser's buttock was torn possibly from hitting the aluminium windowsill
3) The underwear was not torn as bad as the trouser proving that the pull was likely on the trouser to lift TBH from the floor to the window

The AG is such a powerful man he can order the case shut by just stamping 'NFA' on the file. Or does the AG want to show Malaysians and the world how our justice system can be toyed with by the powerful as and when they like – even to the extent of their capability to cover up murders?

I must admit that there is no time limit for evidences to surface even if a case is closed and should it warrant, the case can be re-opened. Likewise for the murder of Altantuya, even though the murderers have been found guilty and sentenced to death, should new evidence surface to show another person or the mastermind who was behind the murder, that person can still be charged.

In Teoh Beng Hock's case, it looks suspicious when a new piece of evidence, widely believed to be a suicide note was found inside the deceased's sling bag. The press statement from the AG's Chamber regarding this new found evidence does nothing more than to show how sloppy the investigation was carried out right from the initial stage. There is heavy suspicion of fabricated evidence being planted.

Let us take a look at what the AG statement claimed: In italic is the AG statement and my rebuttal in normal font.

"The Attorney-General Chambers was informed of the discovery of the note by the Investigating Officer, ASP Ahmad Nazri bin Zainal on 7.10.09 some two over months after Teoh Beng Hock's death. According to the Investigation Officer it was not found when he first searched the deceased's sling bag after the incident."

Can you see how desperate they are to fabricate evidence by saying something that stupid to try and convince you "it was not found when he first searched the deceased's sling bag after the incident". They did search the sling bag after the incident but the 'supposed' suicide note was not there. Yet after two months, they managed to discover it.

From a layman's understanding, after the police, MACC, AG, the forensic and hospital had fully completed their investigation, all personal belongings of the deceased should have been itemised, tagged and recorded after a thorough search. Those items that required to be produced as evidence will be retained under locked and key while the rest should be returned to the family members.

The questions are:

Why was the sling bag not returned to the family members?

If it was not returned, how was it to be used and considered as evidence in the inquest/trial?

If they really needed to make a search again, why were all parties not informed?

To me, the only reason is to plant fabricated evidence.

"The note was immediately translated and there was sufficient cause to send it to be analysed by a Document Examiner of the Chemistry Department. The said note was sent on 9.10.09 and subsequently on 20.10.09."

Should not all parties be informed unless they are trying to fabricate evidence.

"The Document Examiner prepared his reports and they were considered by the Attorney-General himself where the Attorney-General, Tan Sri Abdul Gani Patail was not convinced of the authenticity of the note due to insufficient samples to verify the handwritings in particular the Chinese characters.

In addition, the note was said to be discovered some two over months after the death and that this would raise suspicion over its authenticity and discovery.

Having considered these factors, Tan Sri Abdul Gani was of the view that the note should not be tendered until and unless the Investigation Officer could provide satisfactory explanation as to its discovery."

These are just frivolous statement, a camouflage for appeasing those who are stupid.

"As regards the note, the Attorney-General's Chambers was earlier briefed by the Investigation Officer that he conducted a thorough search after being advised by the psychiatric that ordinarily there would be a note left in a suicide case.

However, recently the Investigation Officer owned up by admitting that he did in fact find the note when he searched the sling bag on 17.7.10 but did not realise the significance of it as there were other documents found and that they were written in both Chinese and Roman characters."

This is indeed a masterpiece, base on psychiatric advice, they went hunting for a suicide note and wallah! a suicide note was discovered. How convenient, they found nothing in the first search, but after talking to the psychiatric they suddenly managed to find one suicide note.

Can you see how sloppy they are? Even when wanting to plant fabricated evidence.

Windows XP: The mouse and keyboard are not working; there is IRQ Resource Conflict

I have spend over 2 days looking for the solution to the mouse and keyboard not working for Windows XP after the manual system restore.

PROBLEMS:
1) After you restore the system restore from the Recovery Console for Windows XP, you may find that the mouse and keyboard (both serial ports) are not working.
There is yellow exclamation mark at the Device Manager for the keyboard and it shows Resources Conflict between the mouse and keyboard.

You can use USB Mouse to plug into the PC which will be able to work despite of the Resources Conflict for PS/2 mouse.

2) Your PS/2 mouse and keyboard are not detected by Windows XP after installing of software

3) Keyboard is not working for Windows XP due to Code 39 error message at Device Manager

Possible Root Cause of the problems: Registry File has corrupted entry for "Kbdclass" data which altered to format like "tphclhs kbdclass"

Solution: Find the corrupted data entry in the Registry and edit them back to "Kbdclass"

STEPS BY STEPS GUIDES

1)Start> Run> type regedit or go to Regedit32.exe located at the system32 folder at C:\Windows\System32\Regedit32.exe.

As you cannot type, you can copy and paste from the saved file that you opened before starting to edit the registry.

2) Click on Edit -> Find, Type in 'Upperfilters' and look at "Keys", "Values" and "data" but
uncheck "Match whole strings only"

3) Search for as many 'Upperfilters' as you can find. First start from the path as stated below and
look for data with entry "kbdclass" and other like 'tphclhs kbdclass'.

HKEY_LOCAL_MACHINE\SYSTEM\CurrentControlSet\Control\Class\

NOTES: There are several drivers associated with Upperfilters eg PartMgr, kbdclass, mouclass which must NOT
be deleted otherwise Code 10 error message will appear to say that driver cannot be loaded

4) Double click the 'Upperfilters' and only edit the corrupted data eg.'tphclhs kbdclass' to 'kbdclass'

5) Search for all instances of this and change only corrupted data to 'kbdclass' at HKEY_LOCAL_MACHINE Registry

6) Go to Device Manager and uninstall your keyboard - then 'scan for hardware changes'. The keyboard driver
should be able to load and ask you to restart the PC

7) You will need to restart the PC in order to complete the installation of keyboard driver

RM15 million ringgit pledge to Chinese schools is a bait for votes

I suggest to vote against BN so that by next GE or State Election, you can expect 100 times increase in allocation to SIBU in order to win back the hearts of SIBU PEOPLE. From RM18 mil to RM1.80 billion for SIBU is achievable if SIBU Chinese voters vote for DAP. If the voters bow down to Money this time, you will get no pledge next time. The trick is to with-hold the vote from BN this time and you can get more next time around!

PEOPLE's power is the real political game. PEOPLE are wise to control money and not let money be the masters over us. So voters can take the Money and vote wisely.

In their moment of jubilation over this once-in-a-lifetime titanic windfall of cash for the Chinese and Christian schools, the local community should perhaps ponder these questions:

· If there was no by-election, would these schools have received any of the above cash?

· Does anyone have the slightest doubt of what Najib wants from you as a trade off?

· Was it not absolutely clear to you that Najib was asking for your votes when he gave you the money?

After pondering over the above events for a few moments, it should not be too difficult for the average person to establish the following:

Najib was trying to solicit for your votes with the above cash hand-out.
The money does not belong to Najib or Barisan Nasional, but to the citizens of the country.
Such impromptu hand-out of cash with the ulterior motive to bribe for votes is an abuse of power in addition to committing corruption.

Now, what should we do with the prime minister who has just committed election bribery as well as abuse of power?

We can report his offence to the Election Commission (EC) and the police for them to take action against him.

Or we can take legal action like what Pakatan Rakyat leader Datuk Zaid Ibrahim is doing over similar offence in the recent Hulu Selangor by-election.

The first option did not seem to work, as the EC and police have always played deaf and blind to election offences committed by BN leaders.

The second option did not seem to have made an impression on Najib and his cohorts, otherwise Najib would not have so openly committed the same offence.

Fortunately, we have the third option which is also the most powerful and the most effective. And that is to cast your votes against those who try to bribe you.

The Chinese community in Hulu Selangor has just done it. Najib had offered to give RM3 million cash to the Rasa Chinese Primary School on condition that they voted for BN. Despite that tempting offer, over 80 per cent of the Chinese in Rasa voted against BN. They would rather sacrifice the much needed cash than to give up their principle.

And that principle is: Votes are not for sale. It is better to forego short-term benefits than to destroy our long term interests of struggling for a good government to replace the rotten one, a sample of which has been more than clearly illustrated by the conduct of the prime minister himself.

Granting a victory to BN in Sibu is to endorse the perverted principle that it is legally and morally acceptable to use money and other inducement to buy votes. And that would be the last nail to the coffin that has already virtually buried democracy in this country.

And so the people of Sibu have the wonderful opportunity of putting a stop to this nonsense and save our democratic way of life from extinction by casting their votes wisely.

KUALA LUMPUR: Datuk Seri Anwar Ibrahim has failed to get the written statement of Mohd Saiful Bukhari Azlan from the prosecution.

The High Court here ruled Wednesday that there was no contradiction on the part of Mohd Saiful over evidence that the sodomy incident had occured without his consent.

Justice Mohamad Zabidin Mohd Diah said earlier that the Attorney-General had discretion to frame a lesser charge, although there was strong evidence against the person.

Anwar's lead counsel Karpal Singh has applied for a stay of the trial, pending an appeal over the dismissal of the application to supply Mohd Saiful's written statement to the defence.

The court stood down for an hour to decide over the stay appeal. The judge also reminded the parties over the existence of "contempt proceedings" in his court, and adjourned.

Court proceedings resumed at 11.05am.

The stay appeal was rejected by the court and Mohd Saiful will continue to testify.

Karpal submitted that the court would be in contempt if it ignored a Federal Court case law which required Anwar to file an affidavit first to apply for stay.

On Tuesday, Karpal applied for Mohd Saiful's statements recorded during the investigation of the sodomy case to be supplied to the defence for the purpose of cross-examination.

Karpal argued that the charge against Anwar under Section 377B of the Penal Code was for committing the sexual act with consent, while Mohd Saiful's evidence in court and his witness statements implied an alleged offence under Section 377C for a sexual act without consent.

He submitted that the defence had the right to have the statements to study the possibility of impeaching Mohd Saiful.

"Mohd Saiful stated in his police report that the incident took place without his consent. He confirmed this when he testified in court on Monday and he alleged the same thing today (Tuesday).

"This is not an ordinary case. The attention of the court is being directed to the contradiction and the court has to determine the discrepancies and decide over this.

"If we can prove that the witness lied in court, then we can impeach him," Karpal said.

Karpal contended that the issue of contradiction was being raised for the first time in Malaysian legal history.

Lead prosecutor Solicitor-General II Datuk Mohd Yusof Zainal Abiden said there was no basis for the court to direct the prosecution to provide a copy of the statements to the defence.

He said the Attorney-General had the discretion when deciding to frame a lesser charge against Anwar.

Anwar, 63, claimed trial to sodomising 25-year-old Mohd Saiful, his former personal aide, at the Desa Damansara Condominium in Bukit Damansara on June 26, 2008.

Meanwhile, the trial was adjourned to Thursday after Karpal Singh told the court he had had filed a notice of appeal at the Court of Appeal to to stay proceedings pending the appeal.

The judge said that the court would hear the application for the stay of proceedsings on Thursday.

They are both good people who deserve your love and care for them. So how do you decide and who do you vote for? Here are some of the principles which are based on the will of God and the commandments of our Lord Jesus Christ.

If you really love both of these 2 potential candidates for MP, you should not cause any one of them to sin or bring the curse upon them and their families to the third or fourth generations.

What sort of party and the alliance party each of them stand for? Bro. Robert Lau Jr stands on BN ticket while Bro. Richard Wong stands on DAP Ticket. DAP being an Opposition Party is not bad because they are the watchdog in the country to keep as "check and balance". SUPP being in power for the last 24 years consecutively have to prove if they have fulfilled all the promises they made to SIBU PEOPLE.

If SUPP had lie to SIBU PEOPLE for the last 24 years and yet you loved to vote for the liar then you are accountable to GOD on the Day of Judgment. You cannot excuse yourself for supporting evil and injustice by voting in some one who represent the party which had lied to the people and had not served the people with a sincere heart.

Here are the list of wrongs which SUPP have not helped to eradicate the evil in the land of SIBU. As Christians you are responsible for supporting an evil party or evil alliance who does not practice true democracy and justice in the country.

Stop having a naive mentality. You should support justice and truth and not be deceived by Devil or workers of Satan who do not practice what they preached.

Case 1 - Perak State govt was formed by 3 frogs bought over by corrupted men and racist alliance party with low mentality. PM should have restored justice and true democracy in Perak by dissolving the State Assembly and call for a fresh election to restore public confidence. Did SUPP voice out against injustice???

Case 2 - Altantunya was blown up by C4 from corrupted men from party who were greedy for money and judge was fixed for the case. Did SUPP practice justice in this case???

Case 3 - Teoh Beng Hock was murdered by people who wanted to wrestle the power from the state govt. Did SUPP practice justice in this case???

Case 4 - Churches were burnt or damaged by people of the same color who hated Christians. Did SUPP champion for the rights of Christians in Sibu and Malaysia???

Case 5 - Anwar was framed of Sodomy charges by people who hated him for his success to mastermind and usher the victory in the last GE. Saiful confessed that he met with Najib and police officers before lodging the police report and going for medical examination. These are proof of conspiracy against Anwar. Did SUPP condemn the PM for framing false charges against Anwar???

Case 6 - SUPP has failed to set up the university in Sibu promised to SIBU PEOPLE during the last 24 years! SIBU PEOPLE had been cheated for so many years. What do you as Christian show love and kindness to people who have lied to you and your children???

Do you call such party has Action, Ability & Accountability? 24 years of history has proved that SUPP had failed again and again to voice out for SIBU PEOPLE. A MP for a party which has no voice in the BN Alliance is akin to a PUPPET MP who can merely bow down to pressure of the big brother. Look at Prophet Daniel in the Bible, did he bow down to political pressure? No. So those so-called Christian MPs have not lived up to the example of Prophet Daniel.

If you love Bro. Robert Lau so that he will not commit the sin of hypocrisy and lies, then do not vote him in for the MP post. Vote for DAP as Bro. Richard Wong has gut to speak out in the Parliament for SIBU PEOPLE. If you cause Bro. Robert Lau to sin, then you are accountable of his sin because you failed to lead him away from dirty political alliance that he works for.

If not for DAP, do you see the PM and top VIPS from Peninsular coming over to SIBU these few days for campaigning in the by-election? I bet you cannot see them flying over to SIBU so frequently or willingly after the by-election - common excuse is busy!

SIBU PEOPLE are the MASTERS who decide for the next MP for SIBU. You are "masters" must pay for the what is due to your "Servant" you choose to represent you.

Col 4:1 Masters, give unto your servants that which is just and equal; knowing that ye also have a Master in heaven.

As Christians or allegorically "masters" who decide the Servant to be elected for the MP post, you have to give to your Servant that which is just and equal. DAP Richard Wong has served as watchdog for the last 24 years. Does he deserve to be paid by a vote from you this time? May God guide your conscience as true Christians who obey the commandments of God without question.

Good news for 246 families

SIBU: Some 246 families living in an under-developed region in Sungai Igan near here will receive a total of RM147,600 as a one-off allocation from the Federal Government.

Chief Minister Tan Sri Abdul Taib Mahmud said he had just received word that each of the families would receive RM600.

"The Prime Minister just informed me that he had approved the assistance for families from all the 12 longhouses in this area.

"Barisan Nasional is concerned about all people regardless of where they are living.

"Over the past 20 years, I have been visiting longhouses in the state but still, it is not possible for me to visit everyone.

"There is still a lot of work to do and the longhouse people must continue to remain loyal to Barisan," he said at Rumah Daniel, Tanjung Penasu, located along Sungai Igan.

He said in the eyes of Barisan, everyone was equal and deserved equal treatment.

However, those who are weaker need more help, he added.

"Our commitment is to help everybody so that they will one day be able to enjoy the same standard of living, whether they are from the rural areas or the urban areas," he said.

Taib also promised the longhouses there that he would give them generator sets if they did not have any electricity supply yet.

However, he said the state government did not have enough funds to give to every settlement immediately and that these development funds need to be channelled in stages.

During his visit, the longhouse elders told Taib that their settlements were badly affected by floods every year.

The roads were in bad shape and needed repair and upgrading urgently, they said, adding that other basic amenities like water and electricity were still lacking.

MACC's Bluff Exposed

The interpretation of "day-by-day" in the MACC Act is the main item for debate by the High Court before the ruling. Common sense will tell us that a day is 24 hours while working hour is latest till 5:30 pm for civil servants. Should the phrase "day-by-day" means 24hours non-stop till the case is finalised, then all MACC Officers should not go home at 6AM but have to stay back till the matter is completed. As that phrase is illogical to mean 24 hours a day, then it remains reasonable to layman's term of office hours from day-to-day basis. So it is confirmed that MACC bluffed the public that they obeyed the Law by interrogation of witnesses till early morning.

The Malaysian InsiderNOV 19 — Whatever the Teoh Beng Hock inquest finally concludes, one fact has already been established: The Malaysian Anti-Corruption Commission (MACC) was negligent or, at least, inept in keeping the political aide overnight as a witness.

Even before the Kuala Lumpur High Court ruled today that witnesses can only be questioned during office hours, most reasonable Malaysians found it incredulous that anti-graft investigators had subjected Teoh to sleep-depriving interrogation, which began in the evening and went right through to early hours of the morning.

Following the discovery of his body outside their Selangor headquarters and to stanch the tide of criticism which followed, the MACC argued that its officers were allowed to question witnesses overnight.

During the inquest, a couple of MACC officials conceded that they kept Teoh on a tight leash because they were under pressure to complete the probe into the misuse of state funds by a DAP state assemblyman.

There were insinuations of a possible suicide although renowned Thai pathologist Dr Pornthip Rojanasunand thought otherwise. Her testimony has resulted in Teoh's body being exhumed this weekend for another autopsy to establish the cause of his death – homicide or suicide.

But we had all long suspected that the MACC bent the law to suit their own needs in detaining Teoh, who was officially just a witness.

We suspected that the MACC paid scant attention to procedures in questioning Teoh because they usually pay scant attention to procedures.

Now we know that our hunch was spot on. The MACC had no business keeping Teoh beyond 5.30pm. He should have been allowed to go home.

Today's High Court ruling has come too late for Teoh. It has come too late for his family, fiancée and unborn child. They are deprived of a son, a husband and a father respectively.

But the ruling will ensure that other witnesses do not suffer the same fate as the political aide.

Well, if all enforcement agencies follow the law, a law that is not really a new law in the first place. MACC must itself learn to respect the law that it wants others to respect. Not to cover up its tracks like those that it seeks to ferret out in the fight against corruption.

Otherwise, what is the difference between MACC and the corrupt?

Inquest: Teoh 80% homicide!!!

Now the balance of probability of death is shifted toward 80% homicide!!! This is very serious as it should be re-classified as homicide until evidence disproves it. As for a homicide case, even though the body remains found 6 months later could be examined for cracks and signs of fracture skull and broken bones in order to determine the cause of death. I admire her courage to speak in truth based on her expert knowledge from years of experience in the field of her work. For true justice to Teoh Beng Hock, an autopsy by Dr. Pornthip would be necessary unless her statement under oath could be accepted as evidence without further questions.

21-10-2009 SHAH ALAM: There is an 80% probability that the death of political aide Teoh Beng Hock was a homicide, said renowned Thai forensic pathologist Dr Pornthip Rojanasunand.

Testifying in the inquest into Teoh's death Wednesday, she said there was only a 20% chance that Teoh had committed suicide.

She added that marks on Teoh's neck region looked like he had been strangled manually.

"The contusion of the skin on the right side of the neck looks round, indicating it might have been caused by fingers," she added.

Counsel representing the government Tan Hock Chuan then suggested that she did not have the locus standi to arrive at her opinion.

"Since you did not conduct the post mortem or inspect the body or go to the scene of the incident and not furnished with the report and photos, is it not appropriate to form an opinion on mathematical terms that suicide is 20% and homicide 80%?" he asked.

Dr Pornthip replied she did not take sides and her work involved taking care of the rights of the dead, adding that she only based her opinions on the evidence provided.

This prompted Tan to rephrase the question by suggesting that the limitations she faced was insufficient to help Dr Pornthip to arrive at the conclusion that it was 80% homicide and 20% suicide.

"It is my field, my work and I believe in that. It is more scientific," said Dr Pornthip, adding that she did not agree with some opinions of Universiti Malaya Medical Centre's Dr Prashant Samberkar on why Teoh's death could have been a suicide.

However, she added she did not want to criticise the opinions of other forensic pathologists.

She said her opinion was based on her years of experience and not aimed at contradicting the police or other medical professionals.

Dr Pornthip, who is the director-general of Thailand's Ministry of Justices Central Institute of Forensic Science, had been invited to give her expert opinion by the Selangor state government.

She is well-known for her prowess in solving complicated homicide cases and is a celebrity of sorts in her homeland.

She is the author of Investigation of Corpses which sold 100,000 copies in Thailand, and also led a group of international forensic scientists in 2004 to identify the remains of the Asian tsunami victims.

Her life and work was narrated in a National Geographic documentary entitled Crime Scene Bangkok in 2004.

Dr Pornthip told coroner Azmil Muntapha Abas that she is willing to conduct a second post mortem on Teoh if his remains are exhumed.

She said she would be able to come up with a more concise and detailed analysis if she could examine Teoh's remains.

To a question by Gobind Singh Deo who is holding a watching brief for Teoh's family, Dr Pornthip said she would still be able to conduct the post-mortem in spite of the deceased being buried almost four months ago.

When asked if the second post mortem on Teoh's body would put her to a disadvantage, Dr Pornthip said there would not be any disadvantages but only limitations due to the decomposition which could destroy everything if a second post-mortem was prolonged.

Questioned by Malik Imtiaz Sarwar, the counsel holding a watching brief for the Selangor government, Dr Pornthip said several injuries sustained by Teoh appeared to be inconsistent with a fall from a high place, and appeared to be pre-fall injuries instead.

(Dr Pornthip had been provided with pictures of Teoh's injuries and post-mortem reports by Dr Khairul Aznam Ibrahim from the Tengku Ampuan Rahimah Hospital and by Universiti Malaya Medical Centre's Dr Prashant Samberkar).

Malik Imtiaz: Can you explain why not all the injuries were consistent with a fall from a height?

Dr Pornthip: The first is the anal injury; from the picture there's a penetrative injury at the anal region. I have never seen this type of injury in cases of fall from height.

She added that if the injury had indeed been caused by a bone protrusion, it would have come from the inside of Teoh's anus as opposed to being a penetrative injury.

Dr Pornthip also said the abrasions found on Teoh's upper right thigh also appeared like he had been beaten with a piece of wood.

There is more than one line and the direction of the force on the thigh is different from the direction of the penetrative injury to the anal region, she said.

According to Dr Pornthip, there was a need to open the skin in the area where the haemorrhage was found to determine if torture had been involved. (Both the pathologists who had conducted the post-mortem on Teoh had failed to do so.)

She added this was necessary to determine whether the haemorrhage was compatible with a fall from a height and single impact from the ground.

Dr Pornthip also said Teoh's skull fracture was not typical of a transferred injury due to a fall but was more compatible with a blunt force being directly inflicted to the head.

She said the transferred injury to the skull due to impact of the fall would typically cause a ring fracture at the base of the skull around the spinal column and not a cervical spine fracture such as that suffered by Teoh.

Dr Pornthip said Teoh, 30, was probably alive when he hit the ground but may have been unconscious before the fall.

She added this was in view of the fact that there was no reaction or defensive wounds on his ankles and wrists which would have occurred if he had been conscious.

Dr Pornthip added that these wounds would occur when a conscious person tries to break his fall which was a natural reaction when one is falling from height.

There's a possibility that he was unconscious from the manual strangulation or pain from the anal region, she said.

Teoh, the political secretary to Selangor executive councillor Ean Yong Hian Wah, had been summoned to the Malaysian Anti-Corruption Commission (MACC) office at the 14th floor of Plaza Masalam to be questioned over the irregular disbursement of state funds on July 15.

He was found dead on the fifth floor service corridor of the building the following day.

Meanwhile, the Selangor government called on the authorities to study the evidence of Dr Pornthip that Teoh's death was a probable homicide and that he could have been strangled before falling from the 14th floor of Plaza Masalam.

"Her evidence has indeed proven that the state's fear on the safety of government officials during interrogation by MACC is not totally unfounded," said Selangor Mentri Besar Tan Sri Khalid Samad in a statement Wednesday.

Given her experience, he said that Dr Pornthip's evidence could not be taken lightly.

He reiterated his government's call for a Royal Commission of Inquiry into Teoh's death instead of just looking into the interrogation methods used on him by the MACC.

The inquest has been adjourned to Nov 9.

Comments on MACC officers lodge police report to deny torturing suspect

SHAH ALAM, Sept 9, 2009 – Five Malaysian Anti-Corruption Commission (MACC) officers, including Mohd Ashraf Mohd Yunus, the witness in the inquest into the death of political aide Teoh Beng Hock, lodged a report at the Shah Alam police headquarters here today.

Selangor MACC director Jaafar Mahad said the officers lodged the report at 4.30pm refuting the allegation that MACC officers' had used force during interrogation.

"We are refuting the allegation that we tortured the suspect. The statement made during the inquest proceedings was ill intent and meant to mar the reputation of the MACC," he told reporters after accompanying the officers to the police headquarters to lodge the report.

In the inquest proceedings earlier today, T. Sivanesan, a witness called by the lawyer representing Teoh's family, Gobind Singh Deo, claimed that he was tortured by MACC officers during interrogation.

Teoh, 30, was found dead on the fifth floor of Plaza Masalam on July 16, after giving statement to the Selangor MACC, located on the 14th floor of the same building. – Bernama

COMMENTS

The workforce of MACC does not comprise of only 5 MACC Officers. So the 5 MACC Officers are the good ones. Where are the other MACC Officers? Does it mean those who did not appear at the Police Station did torture the witnesses and compel them to disclose as much information as possible.

Secondly, why the Police did not investigate Sivanesan's police report last year? Now of course the injuries on the body of Sivanesan had healed. But the medical report, photos of the injuries and the boldness to testify at the inquest speaks volumes. MACC has the losing battle to fight on.

Why the 5 MACC offiers waited for such a long time to lodge police report to refute or counter the allegation made by the mysterious witness, Mr. T. Sivanesan? Correct me if I am wrong. I think the mysterious witness lodged the police report some where in September 2008. This is called "a tooth for a tooth".

What Siva wanted to do is to seek justice for Teoh Beng Hock? That is the real reason, he volunteers to testify today. Siva, you are our hero. The question that strikes my mind is "Why the police did not investigate the report lodged by Siva ages ago"? If this had been done when the report was lodged, the story would had been totally different today. So, who will take the blame now? They asked for it.

Hey, why only 5 officers lodge police reports. The whole department should lodge police reports to ensure a more thorough investigation could be initiated.

The whole department should lodge police departments because those who had lodged police reports most probably do not have any recorded history of actually being involved in use of force against witnesses or suspects (unless identified by the witness) but others in the department might have a history of violence towards witnesses or suspects and dare not lodge any police reports.

There is always something called peers pressure and once a "leader" starts using violence, the rest of his/her subordinates will be more inclined to follow suit in order to remain as an acceptable member of the group. Once violence is initiated, a feeding frenzy of violence will ensue as herd mentality takes over the group.

Surely this is not the correct procedure.
Otherwise anyone can lodge a police report to counteract any reported crime and there will be no use of the courts.
If a police report has been made, the police should check out the facts of that report and if a false report had been lodged, action can be taken against the person.

Comments on Teoh family outraged at MACC chief's suicide theory

KUALA LUMPUR, Sept 7, 2009 – As the inquest into the death of a Selangor government political aide drags on with no clear end in sight, his grieving family’s frustration is fast turning into fury.

This is especially over the latest reported remarks made by the chief commissioner of the national anti-graft body, which many believe to have had a hand in pushing him over the edge.

The family of the late Teoh Beng Hock denounced the Malaysian Anti-Corruption Commission’s (MACC) Datuk Seri Ahmad Said Hamdan for publicly insinuating that the 30-year-old political secretary had committed suicide because he “could not withstand the pressure”.

Teoh’s younger sister, Lee Lan noted that Ahmad Said had told Chinese-language daily, Sin Chew Daily, earlier this month that he had been informed of 10 cases of people jumping from buildings after being investigated by Hong Kong’s Independent Commission Against Corruption (ICAC) since its set-up.

The MACC, formed in January this year, was modelled after the ICAC.

“He also said that if people investigated could not withstand the pressure and jumped from the building, there was nothing that they (MACC) could do,” Lee Lan told The Malaysian Insider, repeating her statement to reporters last Saturday after saying prayers for her brother at the Seck Kia Eenh Temple in Malacca.

“If the MACC continues to make irresponsible remarks which cannot be substantiated with proof, we are prepared to go and see the Prime Minister again to urge him to immediately set up a comprehensive Royal Commission of Inquiry to investigate into Beng Hock’s cause of death,” she added, speaking for the rest of her family.

The family scored a meeting with Datuk Seri Najib Razak in his Putrajaya office on July 28.

“No stone will be left unturned in finding out the real cause of death and, if there is any foul play, action will definitely be taken,” the PM promised them then.

Ahmad Said was quoted to have said that in the history of the Independent Commission for Anti-Corruption (ICAC) of Hong Kong, there were a total of 11 suicides of suspects and that there was nothing that the ICAC could do about it.

“Although this may have been a statement of fact with respect to the ICAC, an open comment by the MACC Chief at this juncture when the inquest is on-going could be construed and perceived as suggesting that suicide might have been the cause of Teoh’s death, while the inquest has not come to any conclusive judgment,” said Koh

I would like MACC to elaborate on these few questions and see if the number of death under ICAC is conclusive for the death of Teoh Beng Hock!

How was the method of interrogation of HK's ICAC similar to MACC? MACC Officer Mohd Ashraf Mohd Yunus had testified there was only an interview and not interrogation. So what pressure was Ahmad Said talking about?

Knowing that there were 10 suicide cases of death under ICAC because of "pressure" from investigation, why MACC did not take precaution to safeguard the safety of Teoh Beng Hock until he left the premises???

Out of the 10 cases of death under HK's ICAC, how many cases were death at the building of ICAC and it covers the span of how many years to produce the statistic of 10 suicide cases?

I highly suspect the DNA sampling of MACC Officers could be "switched" or "replaced" with other unknown people during the transit to the chemist lab. I strongly suggest to call for international DNA experts to extract the DNA sample from all the MACC Officers one more time in the presence of the lawyers for both parties of Teoh's family and MACC. The mystery letter still contains sufficient evidence to investigate further by independent Commission of Inquiry.

KUALA LUMPUR, Sept 7 – As the inquest into the death of a Selangor government political aide drags on with no clear end in sight, his grieving family's frustration is fast turning into fury.

This is especially over the latest reported remarks made by the chief commissioner of the national anti-graft body, which many believe to have had a hand in pushing him over the edge.

The family of the late Teoh Beng Hock denounced the Malaysian Anti-Corruption Commission's (MACC) Datuk Seri Ahmad Said Hamdan for publicly insinuating that the 30-year-old political secretary had committed suicide because he "could not withstand the pressure".

Teoh's younger sister, Lee Lan noted that Ahmad Said had told Chinese-language daily, Sin Chew Daily, earlier this month that he had been informed of 10 cases of people jumping from buildings after being investigated by Hong Kong's Independent Commission Against Corruption (ICAC) since its set-up.

The MACC, formed in January this year, was modelled after the ICAC.

"He also said that if people investigated could not withstand the pressure and jumped from the building, there was nothing that they (MACC) could do," Lee Lan told The Malaysian Insider, repeating her statement to reporters last Saturday after saying prayers for her brother at the Seck Kia Eenh Temple in Malacca.

"If the MACC continues to make irresponsible remarks which cannot be substantiated with proof, we are prepared to go and see the Prime Minister again to urge him to immediately set up a comprehensive Royal Commission of Inquiry to investigate into Beng Hock's cause of death," she added, speaking for the rest of her family.

The family scored a meeting with Datuk Seri Najib Razak in his Putrajaya office on July 28.

"No stone will be left unturned in finding out the real cause of death and, if there is any foul play, action will definitely be taken," the PM promised them then.

SHAH ALAM AUG 28, 2009: The inquest into the death of political aide Teoh Beng Hock heard of alleged torture of witnesses by MACC officers at the 14th floor of Plaza Masalam here.

Gobind Singh Deo, who is holding a watching brief for Teoh Beng Hock's family, told coroner Azmil Muntapha Abas on Friday that he had before him a police report which detailed how witnesses and suspects were allegedly tortured during interrogation.

He claimed that among the forms of abuse listed in the report were repeated slapping to the face, blindfolding, asking the witness to strip, wrapping a steel rod with a newspaper and using it to hit stomach, arms and legs.

Gobind also told Azmil that he would bring a witness who had been subjected to torture and abuse during interrogation by MACC.

"The witness will identify the MACC officer involved. However, I cannot reveal the name of the witness for now because for security reasons," he added.

The revelation came about when Gobind was questioning the inquest's 19th witness - Selangor MACC officer Mohd Ashraf Mohd Yunus, 25.

Below is an account of the inquest on Friday as they unfolded.

12:29pm: Court adjourns to Sept 8.

12:25pm: Coroner tells Gobind to not stretch the report outdated ones. Gobind can test his theory before the coroner but he needs to limit it to one report.

11:42am: Ashraf tells the court that he did not hear any shouting. Gobind thunders, "So, who is lying? Bulkani or you?" Razak gets up to object.

11:41am: Coroner tells Gobind not to repeat the suggestion.

11:40am: Gobind suggests to Ashraf that he stayed back at MACC office until 5am to torture Teoh. Before Ashraf can answer, Razak gets up to object.

11:35am: Ashraf says his orders come from his superior, Hairul Ilham Hamzah. Hairul Ilham gets his orders from operations deputy director Hishamuddin Hashim.

11:33am: Gobind resumes questioning Ashraf.

11:27am: Coroner says the court proceedings are recorded and available for viewing on the Attorney-General's website. "I don't see how the court can stop (halang) anyone who wants to make comments outside courtroom. The statements made inside the courtroom are what matters. It is people's opinions versus other people's opinions. If you want to see what happens inside court, you can see the recording on the website. We are dealing with many theories here. We limit ourselves to what happens here (courtroom). What happens outside is beyond our control."

11:24am: Gobind says if Razak had followed the agreement and confined questioning to the four documents from Teoh's laptop, press conferences like what Ean Yong had given would not happen. Gobind says Ean Yong was forced to give the press conference to defend himself and DAP after Razak made the allegations against DAP.

11:18am: Datuk Abdul Razak Musa, representing MACC, tells coroner that the inquest has been politicised with press conferences held outside courtroom. For instance on Wednesday, Ean Yong gave a press conference and commented on the case after court proceedings ended.

11:17am: Coroner's court resumes.

10:37am: Gobind asks for a short break. Court in recess.

10:35am: Ashraf say that he did not see anyone while on his way to the pantry to get water for Teoh. There was also no one in the pantry.

10:30am: Gobind suggests that in that two hours, Ashraf had the opportunity to use force on Teoh. Ashraf disagrees.

10:24am: Gobind: You were asked to shake him up, to break him down.

Ashraf pauses momentarily. He then answers, "It is like to ask a person until you get a correct answer."

10:15am: Ashraf received the order to interview Teoh at 9.40pm on July 15.

10:05am: Ashraf maintains that he did not question Teoh.

Gobind: You didn't ask him? Not a question at all?

Ashraf: No.

Gobind: Then, who reported back to Hairul Ilham?

Ashraf: Arman Alies.

Gobind: You earlier said you reported back to Hairul Ilham. Are you lying?

Ashraf: I was with Arman when he reported to Hairul Ilham.

10:01am: Gobind asks, "But you said Teoh couldn't answer questions. Wouldn't questioning him be an interrogation?" Ashraf said the questions came from Arman Alies and not him. The questions were regarding claim vouchers by Teoh's boss, Selangot exco Ean Yong Hian Wah.

10:00am: Ashraf says he did not "interrogate" Teoh. He merely "interviewed" Teoh in the meeting room.

09:57am: To a question, Ashraf tells court he has never heard of the word "oppression".

09:54am: Among the investigation techniques Ashraf has learnt is how to mark investigation papers, how to compile witness statement according to significance and flow. However, he told Gobind that he was not taught interrogation techniques on witnesses.

09:51am: Ashraf said before joining the MACC, he had a six-month stint at Pulapol (police training centre) in Ayer Itam.

09:49am: Gobind Singh Deo, representing Teoh's family, is questioning Ashraf.

09:46am: Ashraf says he last saw Teoh when he gave Teoh the glass of water. He did not see anyone with Teoh at the couch when he gave water to Teoh.

09:42am: Ashraf left MACC office at 5.06am, July 16. He clocked out with his punch card when he left.

09:40am: Ashraf got out of his room and saw Teoh on the couch. He did not speak to Teoh. Teoh had asked for water. Ashraf took a glass of water from the pantry and brought it to Teoh.

09:35am: Ashraf saw Teoh lying on the couch in the waiting area (ruang tamu) of the investigation division at 4.45am on July 16.

09:29am: Ashraf tells coroner's court the interview, conducted with another MACC officer Arman Alies, lasted from 10.40pm to 12.40am on July 16 in MACC office at Plaza Masalam. He said Teoh was generally co-operative although there were a few questions he could not answer.

09:25am: Tan Hock Chuan, acting for the Attorney-General, is questioning Ashraf. Ashraf said he received orders from superior Hairul Ilham Hamzah, to assist investigating officer Mohd Anuar Ismail to interview a witness, Teoh Beng Hock.

QUESTIONS

Why Mohd Ashraf Mohd Yunus only left MACC office at 5:12am on July 16, 2009 when the interrogation was said to be over at 12:40am or Teoh was allegedly discharged at 3:45a.m.??? Why he stayed behind till 5:12am if the recorded statement was already signed by Teoh at 3:45am??? There is something irreconcilable in term of the task assigned to him; I doubt he was the person typing the statement or he have to assist other officers unless it was meant to torture whoever witnesses at MACC on rotation basis! Mr. Gobind should grill the MACC Officers for reasons as why they stayed behind if the interrogation was allegedly over at 3:45am!

SHAH ALAM, Aug 27 – An anti-graft officer today appeared to contradict the testimony of his colleague who said earlier that Teoh Beng Hock had an argument with Kajang Councillor Tan Boon Wah at the Selangor Malaysian Anti-Corruption Commission (MACC) office.

Assistant enforcement officer Mohd Najeib Ahmad Walad, who was at the MACC headquarters till 2.30am, said he did not hear any fight.

SHAH ALAM 27-8-2009: A Selangor Malaysian Anti-Corruption Commission (MACC) assistant enforcement officer told the Teoh Beng Hock inquest he did not hear the sound of people bickering coming from his office toilet in the wee hours of July 16.

Mohd Najeib Ahmad Walad also testified he was at the state MACC office until 2.30am on that day and added the atmosphere there had been calm.

Mohd Najeib's testimony appeared to contradict his superior officer Mohd Nasir Ismail's testimony on Wednesday.

Mohd Nasir, who is the investigating officer of the case involving Teoh, had testified his colleague Bulkini Paharudin told him the deceased had had an argument with Kajang Municipal Council councilor Tan Boon Hwa on July 16.

Mohd Nasir had told coroner Azmil Muntapha Abas that Bulkini had told him the bickering had allegedly taken place in the MACC's men's room at 2.00am that day.

When cross-examined by counsel Gobind Singh Deo, who's holding a watching brief for Teohs family, Mohd Najeib said he would have run away if he had heard an argument taking place.

03:47pm: Mohd Najeib disagrees with Gobind that MACC officers work in teams to interrogate a witness. For example six to seven officers questioning one witness and the same time.

03:36pm: To a question, Mohd Najeib says he did not hear any shouting or any sound of people arguing as he was leaving the office at about 2.30am.

Apparently some MACC Officers are lying under oath as how could the testimony contradicts with each other? Something very fishy must be going inside MACC premises. If the senior MACC Officer is lying under oath, he is not fit to be a MACC Officer as the public lost confidence on such officer. How could such insincere officers be trusted to do a good job for MACC?

The motive of MACC is to divert the blame to Mr. Tan Boon Wah and exonerate themselves from the responsibility of Teoh's sudden death. MACC IO Mohd Anuar could have been directed to testify in a predetermined manner. But the wisdom of the public and cross-examiners must be exercised to adduce truth from the sincere MACC Officers and exposed the lies of the corrupted MACC Officers, collaborators and their fabricated stories. There are some good and conscientious MACC Officers. Leave no stones unturned in MACC who are dealing with the investigation of Teoh. Prayerfully God shall use the conscientious MACC Officers to reveal the root cause of the death of Teoh. Truth prevails and falsehood shall be exposed!

Still trying to hoodwink the public that Beng Hock was released from MACC custody at 3.45am? Why was his handphone still in MACC's hands 2 days after his death?

Myop101: Someone should actually ask this officer, what are they arguing about and how did he ascertain they were arguing? He should be aware, some Chinese from certain dialect clans do talk loud, sounding as though they're arguing. What more in the toilet, due to echoes, sound resonates louder. Court orders probe into DAP man's accounts

SHAH ALAM, Aug 25 — Magistrate Azmil Muntapha Abas, who is acting as coroner in the inquest of political aide Teoh Beng Hock, today ordered the police to probe four accounting documents found by anti-graft officers and said to be related to the cause of his death.

He also ordered the police investigating officer, ASP Ahmad Nazri Zainal, to record the statement from Selangor MACC investigator, Mohd Anuar Ismail, who was appointed to head the team.

The Malaysian Anti-Corruption Commission (MACC) legal affairs director, Datuk Abdul Razak Musa, who is holding a watching brief for the national anti-graft body, asked Azmil to give the order when the inquest resumed after a one-hour lunch break.

Abdul Razak drew the coroner's attention to four documents, said to have been printed out from Teoh's laptop, which show a discrepancy in monetary claims made by Teoh's boss, first-term DAP Selangor executive councillor, Ean Yong Hian Wah.

Teoh was the political secretary to Ean Yong and responsible for overseeing the assemblyman's claims from state funds.

The coroner's court was told each state lawmaker is entitled to half a million ringgit a year from the state's central fund.

Mohd Anuar had also earlier told the coroner that Teoh was its star witness.

The 30-year-old's body was found sprawled on a 5th-floor landing outside the Selangor MACC office at Plaza Masalam here on July 16, the day he was to register his marriage to his pregnant fiancee after close to 10 hours of overnight questioning.

Lawyer Gobind Singh Deo said Ean Yong should be represented in the hearing from this point onwards because the line of questioning would be focused on his involvement into the alleged abuse of state funds.

Gobind, acting for Teoh's family, said he had spoken to Ean Yong during lunch break and the latter said he had "no problems" explaining the accounts but needed to arm himself with a lawyer in the inquest.

The inquest is postponed to tomorrow morning with the MACC officer who had recorded Teoh's last statement, Mohd Nadzri Ibrahim, to step into the witness box.

Today's inquest was a heated affair.

The day's sole witness, Mohd Anuar, a soft-spoken MACC man, visibly quaked under the boiler-room pressure of Gobind's questioning, prompting Abdul Razak to jump to his feet many times in protest.

At one point, the MACC lawyer even said the inquest had turned into a "kangaroo court".

Abdul Razak pointed out that Gobind's grilling of Mohd Anuar over the MACC's interrogation tactics was not relevant to helping the coroner learn how Teoh died.

But Gobind seemed pleased with the result of today's hearing.

Speaking to reporters after the inquest, he stressed that the pattern of Mohd Anuar's testimony from the witness box "were consistent with somebody having something to hide."

"If you look at what he said, if he had been directed not to report, he would not, despite the law requiring him to do so," Gobind added, referring to the MACC man's admission, under questioning that he had

been "ordered" by the deputy director of Selangor MACC, Hishamuddin Hashim, to wait one day before reporting Teoh's death to the police.

Mohd Anuar told the coroner's court he had received a phone call from a fellow MACC officer asking him to head straight down to the 5th-floor landing of Plaza Masalam here, which also houses the anti-corruption body's offices, where he had saw Teoh lying dead at about 2pm.

He said he alerted Hishamuddin but was instead whisked away with the Selangor MACC No.2 and the investigations unit chief to the MACC headquarters in Putrajaya without reporting the incident to the police.

The trio returned only about 5.30pm that day, after police arrived at the death scene.

"Why did you not call the police? Your man, your star witness is dead! Why didn't you lodge a police report?" Gobind pressed.

Mohd Anuar's answers — "On that day, I panicked because I saw a dead body"; "There were many people there" — raised the lawyer's ire.

"My God! What is wrong with you?" Gobind swore.

He made Mohd Anuar read out loud Section 329 of the Criminal Procedure Code (CPC), which deals with the duty of a police officer to investigate deaths.

Mohd Anuar, a practising lawyer until 2004 when he went for training at a police college in Kuala Kubu Baru before joining the MACC as an investigator, reluctantly picked up the law book handed over by Gobind and raised his quavering voice to read:

"Every officer in charge of a police station on receiving information –

(a) that a person has committed suicide;

(b) that a person has been killed by another, or by an animal, or by

machinery, or by an accident;

suspicion that some other person has committed an offence;

(d) that the body of a dead person has been found, and it is not known

how he came by his death; or

(e) that a person has died a sudden death; shall with the least practical delay transmit such information to the officer in charge of the police district."

Gobind echoed his last sentence, placing great stress on the words "with the least practical delay".

Throwing Mohd Anuar a photo file showing Teoh's dead body, Gobind pushed the witness to answer: "Did it not eat into your conscience?

Your main witness was lying outside your office and you sit there and tell me you didn't lodge a police report."

It appeared to be the finishing blow. In a defeated voice, Mohd Anuar said: "Ya."

SHAH ALAM, Aug 24 — The last man to see DAP political aide Teoh Beng Hock alive was graft buster Raymond Nion son of John Timban, a Selangor MACC man told the coroner's court today.

The investigating officer from the Malaysian Anti-Corruption Commission's (MACC) Selangor branch, Mohd Anuar Ismail, is the 16th person to step into the witness stand in the ongoing inquiry to learn how Teoh died.

Mohd Anuar told the coroner's court he only learned later that Raymond supposedly saw Teoh sleeping on a sofa in the MACC office on the 14th floor of Plaza Masalam here as he himself was sleeping in a different room at the same time.

He added that another fellow officer, Mohd Ashraf Mohd Yunus, was the last to speak to Teoh.

"After the incident of Mr Teoh Beng Hock's death, I was informed that at about 5am, he had called Mr Ashraf to ask for a drink and at about 6am, an officer named Mr Raymond had seen Mr Teoh Beng Hock still sleeping on a sofa," the MACC IO replied when quizzed by lawyer Tan Hock Chuan.

Tan is a former deputy public prosecutor who was asked by the Attorney-General to help the coroner in the inquest.

Mohd Anuar also said Teoh, who was found dead on a 5th-floor landing at the MACC Selangor branch on July 16, had been questioned overnight as the main witness into claims that Selangor DAP assemblymen were misusing state funds.

The soft-spoken MACC IO denied that any "force" or "threats" had been used on Teoh during the interrogation.

He noted that two officers who had interviewed Teoh, Arman Alies and Mohd Ashraf Mohd Yunus, had later told him Teoh did not answer several questions on certain "documents" and his laptop but the officer who recorded the deceased's statement, Mohd Nadzri Ibrahim, said there were "no problems"with Teoh.

Mohd Anuar also told the coroner that he had found Teoh's bag, a dark-coloured slingbag, left behind on a sofa in the MACC Selangor office when he finally woke up at 8.30am on July 16, after Teoh was said to have been "released" from questioning.

He said he remembered seeing Teoh carry in the bag when he entered the building the previous day at about 6-plus in the evening but failed to identify the bag when pressed by Tan, who referred him to a photograph.

He had checked with several MACC workers, from fellow investigators including the head of the investigations unit, Hairul Idham Hamzah to the telephone operator to see if Teoh was still in the building, but failed to get a positive answer.

Mohd Anuar told the coroner his next sight of Teoh was after the political aide's death, when he had received an emergency phone call from fellow officer, assistant enforcer Mohd Redzuan Mohamad, who told to go down to the 5th-floor "immediately".

The IO had previously testified that he had been called back to the MACC office by Hairul Idham about midnight on July 16 after leaving at 8.30pm the day before.

However, he himself was not involved directly in the interrogation process despite being the IO, he said in reply to Tan's pointed remark, explaining that officers carried out their jobs based on orders given from a senior officer.

He told the inquest that he had spent most of the hours between midnight and 9am sleeping: first on a sofa, then moving to the surau next to the toilet until about 3am when he was woken up by Mohd Nadzri Ibrahim who told him he had finished recording Teoh's statements.

He instructed Mohd Nadzri to tell Teoh to go home and return the next day to hand over certain "documents".

At 5am, Mohd Anuar moved to the main visitor's room in the front of the office, where he slept with an MACC security guard, Mohammed Khairuddin Denan until 8.30am.

Yet, Mohd Anuar told the court he did not contact Teoh the next morning to follow-up on the "documents" related to the MACC's investigations on the abuse of state funds when Tan probed.

Tan: As the IO, if someone does not bring the documents, do you call up the next day to ask him to bring the documents? Did you telephone Mr Teoh?

Mohd Anuar: No.

Tan: Did you ask any other officer to telephone Mr Teoh?

Mohd Anuar: No.

Tan's eyebrows shot all the way to his hairline when he learnt that Mohd Anuar had not gone home from July 16 until July 18.

The latter's punch card showed he last clocked in on July 15 at 8.22am without ever clocking out, even though he admitted he had left the building at 8.30pm the same day to go home.

Tan: Is it a normal thing for the MACC?

Mohd Anuar: It's a normal thing.

The MACC's legal affairs director, Datuk Abdul Razak Musa, today offered again to supply the coroner with the recorded statement taken from Teoh before his death, which he said may be relevant to show his mental state.

But lawyer Gobind Singh Deo, acting for Teoh's family, pointed out that the recorded statement was only an "interpretation" from the MACC and could not be said to fully "reflect" Teoh's mind when he was no longer alive to prove the truth of the recording.

Malik Imtiaz Sarwar, the lawyer for the Selangor government, was equally cautious for the coroner to accept wholeheartedly the recorded statement.

"We have to study the statement first as we have just received it today. Our main concern is whether it is inded Teoh's statement," he told The Malaysian Insider.

Speaking to reporters after the inquest, Abdul Razak admitted the statement was not a video or audio recording but merely a written record of Teoh's conversation with the MACC officers.

Magistrate Azmil Muntapha Abas, who is acting as coroner, noted that the recording may still show relevance. He said he would decide tomorrow.

COMMENTS

Why should Teoh be considered to be discharged by MACC when his hand phone and slingbag was still in the building???

As the slingbag was allegedly found at 8:30am, it means Teoh was dead between 6am and 8:30am on July 16, 2009. The story that Teoh was sleeping on sofa in MACC is very hard to believe. As this is first in record that a witness is allowed to sleep in MACC building! Secondly, it is illogical that for MACC to say that night interrogation does not interfere with the work of the witness when the IO himself slept through the night.

The recorded statement of Teoh could be doctored as MACC had the specimen of the signature of Teoh. The specialists may be required to identify the signature on the recorded statement. Are all the pages signed by Teoh? If the only last page is signed, there is possibility to insert more pages which Teoh did not utter at all.

Now Tan Boon Wah Kajang Municipal Councillor was called to MACC almost the same time as Teoh. Why Teoh could be "discharged" at 3:45am while Tan was released in the afternoon after signing the recorded statement???

KUALA LUMPUR, 22 July 2009: Kajang Municipal Councillor Tan Boon Wah today sued the Malaysian Anti-Corruption Commission (MACC) and two others for allegedly detaining and interrogating him in an unlawful manner last week.

Tan, 39, filed his writ of summons through Messrs Karpal Singh & Co at the registration office of the High Court Appellate and Special Powers Division here at 12:30 pm.

In his writ of summons, Tan, as the plaintiff, named MACC Chief Commissioner Datuk Seri Ahmad Said Hamdan, Assistant Superintendent Mohammad Hassan Zulkifli, and the MACC as the three defendants.

In his supporting affidavit, the plaintiff claimed that on 15 July, he was taken out of his house by officers of the third defendant to the MACC headquarters in Shah Alam for interrogation at 8:30 pm.

"I was only released at 1:35 pm on the following day, 16 July. This was after I was given an order for interrogation as a witness on 20 July at 10am," said the plaintiff in his affidavit.

"I had been detained unlawfully by the MACC officers. I had stated that I could not, from the legal aspect, be interrogated after government office hours, that is, from 8:30am until 5pm daily, as provided under Section 30(1)(a) of the MACC Act," the plaintiff said.

Subsequently, the plaintiff claimed the move was an unlawful detention, which resulted in him suffering losses and damages.

Through the writ of summons, the plaintiff demanded a court declaration that the defendants, who were investigating under Section 30(1)(a) of the MACC Act 2009, could only record statements from the plaintiff as a witness during office hours only, that is from 8:30am until 5:30pm.

The plaintiff also demanded a declaration order that all the defendants had acted against the provision of Section 30 (3)(a) of the Act, damages for unlawful detention, costs and other reliefs from the court.

Tan is one of several people who were called up by the MACC to give statements in investigations on alleged misappropriation of the Selangor state allocation.

A political aide to one of the Selangor state executive councillors, Teoh Beng Hock, who was called up for interrogation by the MACC at its headquarters on the 14th floor of Plaza Masalam, Shah Alam, was found dead on the fifth floor of the building on 16 July. — Bernama

Good for you Tan Boon Wah. The MACC should be taught a lesson. I don't deny that there are some very dedicated officers but generally the MACC is a big bully legally sanctioned by the BN government.

They investigate selectively [...] and they act as if they are God. They allow people like Lingam, Khir Toyo and Zakaria Darus to walk about freely; the latter in the next world, and yet go all out to investigate Teoh Beng Hock, Tan Boon Wah and other opposition politicians.

COMMENTS

MACC is believed to be reporting directly to Najib PM Office and not to the Parliament. There is no check and balance in MACC. All MACC Officers must declare their assets online. Before these officers are qualified to investigate corruption cases, they themselves must be legally clean and transparent.

SHAH ALAM, Aug 26 - Ean Yong Hian Wah today slammed the Malaysian Anti-Corruption Commission (MACC) for not doing their homework before making unsubstantiated graft claims at the Teoh Beng Hock inquest today

During a press conference today, Ean Yong gave reporters folders containing documents as well as before and after pictures of small projects carried out at his constituency which he claims proved the allegations raised by the MACC were unfounded.

The Selangor executive councillor said the documents and pictures are kept at the District Office.

The Selangor DAP chairman pointed out the MACC had raided the District Office and had seized all documents related to how he spent his state allocation for small projects at his Sri Kembangan Constituency.

According to him, the MACC had tendered in the coroner's court today four claims and quotation documents which were unsigned and not stamped, purportedly obtained from Teoh's computer.

"I have never seen these documents before and they may have been drafts."

Ean Yong said MACC senior enforcement officer Mohd Anuar Ismail had earlier testified that their investigations revealed the work was never carried out by the contractors involved.

The two claims are from Syarikat Aris and Fizami Construction while the quotations are from MKMN Enterprise and MA Bina Melor Enterprise.

"My lawyer Salim Basir had showed the same pictures, quotation and actual claims to Mohd Anuar during the inquest and he had admitted that he had never set eyes on the documents before."

According to Ean Yong, upon being shown the evidence Mohd Anuar had to agree and admit to the coroner that the projects were actually completed.

"I want to ask MACC if they are really carrying out a serious, fair and professional investigation," he said.

"Mohd Anuar, as the investigating officer, should have checked all the documents and pictures before making false allegations in the inquest."

"This clearly shows that the MACC has a political agenda and are not only refusing to take responsibility for Teoh's death but are attempting to tarnish the image of the DAP and Pakatan Rakyat."

COMMENTS

Mohd Anuar was the IO who was sleeping while Teoh was under interrogation. Or could it be that he was not the IO of the case at all but a last minute arrangement to conceal the identity of the real IO. He dared to admit that he was sleeping while on duty. He said that MACC office was open for 24 hours!!! Let him prove it by punch-card evidence. He also dared to admit that "he had never set eyes on the documents before" as an IO but simply accused that the project was not completed at all. Why should MACC retain such kind of IO in office???

On 26-8-2009 11:22am: Anuar explains to the court the reason why MACC conducts night interrogation. He says in some investigations, witnesses who hold day jobs choose to be interrogated at night so it will not interfere with their work. Some witnesses choose not to be seen at MACC building for their own reasons so they choose night time to record their statement with MACC. Anuar adds the MACC office is open 24 hours.

BUKIT MERTAJAM, Aug 26 — If the Permatang Pasir by-election was to gauge the effectiveness of Umno's communal politicking, the results point to only one conclusion: failure.

Mohd Salleh Man, PAS Penang commissioner, beat Rohaizat Othman, the scandal-hit Barisan Nasional (BN) candidate, with a majority of 4,551. The former garnered 9,618 votes against the latter's 5,067.

PAS won in all Chinese dominated areas throughout the state constituency. From the suburbs of Sama Gagah and Cross Street to the semi-rural town of Permatang Pauh, the Islamist party thumped their Umno rivals with big majorities.

COMMENTS

I am of the opinion that the voters are mature and justice-loving people. The candidate of the party plays an important role as the reputation of the candidate shall either tarnish or uphold him in the election. Bad reputation cannot win nor reduce the majority of PAS to a greater extent. Some voters are basically seeking justice for TBH and angry with the corruption of top authorities in the country. Who has the authority to investigate the top ranking officers in MACC? Where is the check and balance for MACC that they will not abuse the powers entrusted to them? Why no investigation conducted into the alleged corruption of the Selangor MACC deputy director Hishamuddin Hashim? Voters are fed up with the corruption of the authorities from top posts and there seems no control over it in the present setup.

The issue of bias treatment of races in the country is against any religious teachings that all men and women are created equal. God gives rain and sunshine to both good and evil people equally, that is truly a just God. So any followers who preach and practise injustice, corruption, abuse of powers, anti-racial, inequality and other malpractices, are anti-God. The reward for anti-God is sure failure to win in the election!

It just goes to show that multi racial politics maybe replacing racial politics. The harder the racial rhetorics by Utusan and BH and esp the DPM the more turned off would the non malays of Umno/BN. However if those ultras in the likes of Hadi, Nash, Hassan Ali and gang in PAS keep coming up and dealing with issues the orthodox way, PAS can't hope to always have the goodwill and trust of the non malays and moderates muslims. PAS please stop telling us that "this cannot, that cannot" eg MLTR concert. How corruptible is MLTR? BY any stretch of imagination they are just a band good at singing commercial love ballads to their fans.

Neither has BN changed its racial tones and racist actions!

To demand means there's failings in BN's undertakings. Gaining acceptance, on the other hand, means that there's no need for demands as the people willingly and wholeheartedly/wholesale embrace the party that wholeheartedly embraces them.

When a party treats a community like dirt to be step upon when they feels like it, then, do you really expect to gain acceptance amongst such communities?

To gain acceptance, there is an unspoken principle that people must be treated with dignity, fairness and courtesy and not be stamped on, beaten up and shouted down when they feels like it and when it's time to come asking for acceptance, offering bribes and sweet whispers on the one hand and at the same time, making racist rhetorics behind their backs.

Good governance and a happy and satisfied community will always lend support to whichever party they feels safe and comfortable with.

Honesty and care for the needs of the people will do wonders to garner support for any party. If only they have the will and ability to embark upon such simple undertakings!

I am not so sure about this analysis. In my opinion, PAS won because they were facing an opponent who is with questionable proffessional conduct. Furthermore, Teoh Beng Hock and PKFZ's case also helped. However, if PAS wants to continue to win Chinese votes, they need to do something about their own people like Hassan Ali. I have been voting for PAS for the past many elections, if this Hassan continues with his kind of action, 308 is my last vote to them.

Umno has misread the minds of the majority of the voters. The 6 losses Umno has suffered in the hands of PR show the people in Malaysia want a truly united nation and they are saying No to racial politics. But Umno/BN think they are still dealing with voters like a few carrots and those they met in the 60's. They still think dangling a few carrots and using the scared tactics will swing the non-malay votes their way. They are stuck in the mud, not realizing the mentality of the people has evolved. It is obvious Umno/BN are at a loss, they do not have a clue as to how to address this new mentality of the modern voters. It is about time such parties, parties which is out of touch with the people and with this world, be allowed to go extinct.

Umno/BN's swan song will be the GE13, no one will regret its passing on, except maybe the Umnoputras!

03:17pm: Abd Razak starts questioning Azhar. Azhar says Teoh appeared restless during the car ride to the MACC office,

03:05pm: Azhar disagrees with Gobind's suggestion that Teoh was asked to drive his own car to MACC office because he would not get out of the MACC building. Azhar, who had the laptop and Hafiz, had the CPU. The two officers rode with Teoh in his car from Ean Yong's office at the state secretariat building to MACC office in Plaza Masalam. Both offices are only a short distance away.

03:00pm: Gobind starts questioning Azhar.

02:56pm: Azhar said he last saw Teoh at 10pm in Selangor MACC office before he left to go back to his Putrajaya base.

02:35pm: Azhar said he was directed by Anuar to bring the laptop seized from Ean Yong's office to the Selangor MACC office in Plaza Masalam. Another colleague Mohd Hafiz Idris was directed to bring the CPU. Azhar said he did not know why he was asked to bring the laptop.

02:10pm: Court resumes. Anuar's testimony of alleged kickbacks made to a political party ordered to be expunged by coroner. 17th witness called to the stand - Putrajaya MACC officer Mohd Azhar Abang Menteri.

12:15pm: Court breaks for lunch. Proceedings resume at 2pm.

11:40am: To a question by Abd Razak, Anuar tells the court that an MACC officer, Bulkani Paharuddin had told him that another witness Tan Boon Wah, was arguing with Teoh in the men's room of the MACC office at about 2am on July 16. Tan, who is a Kajang Municipal councillor, was one of the four witnesses present at MACC that night.

11:30am: Anuar says he didn't lodge a police report straightaway after finding Teoh's body because he believed that the first person who found Teoh had done so. At the time when he saw the body, there were already many people gathering on the fifth floor of the building.

11:22am: Anuar explains to the court the reason why MACC conducts night interrogation. 10:10am: Gobind gets up to object about Anuar's testimony of alleged kickbacks received by a political party. He says Abd Razak has breached what was agreed yesterday, which was for the inquest to stay within the statement taken from Mohd Anuar by investigating officer ASP Ahmad Nazri Zainal. Gobind says Abd Razak is using the inquest as a platform to talk about the entire investigation by MACC. "We have nothing to hide. We can bring our witnesses and justify the allegations by Mohd Anuar. Mohd Anuar's allegations are baseless. it is unfair for my deceased client," Gobind tells the coroner. Abd Razak says the result of the investigation by MACC is important to establish Teoh's state of mind.

09:35am: Mohd Anuar takes the stand for the fourth time. He is now being questioned by lawyer representing MACC Datuk Abd Razak Musa.

09:30am: Coroner Azmil Muntapha Abas allows application made by lawyer Salim Bashir for his client, Selangor executive councillor Ean Yong Hian Wah to sit in the court so that Ean Yong can listen to the testimony of Selangor Malaysian Anti-Corruption Commission officer Mohd Anuar Ismail.

09:25am: Day 14 of Teoh Beng Hock inquest begins.

To recap if Tan Boon Wah had a quarrel with Teoh at 2am on 16-7-2009, it does not make sense as Teoh was only released at 3:45am. It was quite unlikely that Teoh was free to move around in the MACC Building and went to the toilet without escort. It was reported earlier by TheStar that Teoh and Tan did not exchange words but merely gesture on 16-7-2009.

"Meanwhile, Kajang municipal councillor Tan Boon Wah, who was also questioned by the MACC in relation to the same case, said he saw Teoh in the MACC pantry at 6am on Thursday. The motive of MACC was to find a scapegoat to put the blame on. It is necessary to recall Tan Boon Wah and cross-examine him together with the MACC Officer Bulkani Paharuddin who made such statement about the quarrel. Whatever it is still inconclusive that a quarrel if any could result in the destructive state of mind. Rather the sleep deprivation should be used to prove that Teoh could no answer some of the questions of MACC Officers because he was too tired to recall things at the wee hours of the morning.

Teoh's state of mind should be commended by psychologists and not MACC Officers who were of the opinion that kickbacks were involved. Even a person went bankrupt could go through the ordeal. So there is no strong evidence that the alleged deals which was not admitted by Teoh could be speculated as something which could hold his mind from rational thoughts. Suicidal thoughts normally develop from a period of time of depression and abnormal fears of meeting people; basically a person has suffered mental depression for a long period of time and under constant medication. A mental illness person's statement may not be valid in the courts of law as he could experience split personalities such as schizophrenia, hallucination, preoccupied mind and staring eyes.

The conclusive evidence from DNA report is that there are at least one person known as Male 1 who forcibly held Teoh's belt. The force of that person caused the waist belt to tear. Now the pathologists contended that was due to contamination during physical examination of the body of Teoh.

More questions should be asked on security of MACC Office as whether or not visitors can enter the premises without detection and who was the last person who saw Teoh alive.

In the meantime, MACC should be held responsible for the safety of the witnesses until he or she leaves the premises.

SHAH ALAM, Aug 26 – The coroner's court ordered part of an anti-graft officer's testimony expunged from the record after he alleged that Teoh Beng Hock and his boss Ean Yong Hian Wah had received kickbacks.

The order came after an outraged Gobind Singh Deo, the lawyer for Teoh's family, called on the coroner to immediately halt the inquest and initiate a "trial within an inquest" into the corruption allegations.

"Let's also make this a corruption trial of Teoh Beng Hock and the DAP," Gobind Singh Deo demansded, startling magistrate, Azmil Muntapha Abas, who is acting as coroner in the inquest.

On his return after calling a short break, Azmil stressed that he was carrying out an inquest, which is clearly outlined in law as "only an inquiry by a magistrate as to the cause of death and the Prosecution Officer is there not to prosecute anyone but only to assist the court with the examinaion of witnesses for the purpose of giving evidence."

He added that the court's duty was to find out six things:

(1)who the deceased was;

(2)how the deceased died;

(3)when the deceased died;

(4)where the deceased died;

(5)what caused the person to die;

(6)who, if any, was/ were the person(s) who carried out the act(s) or

omission(s) causing the death.

Anti-graft investigator Mohd Anuar Ismail, who returned to the witness box for the third day in a row this morning, told the coroner's court that Teoh and his boss, first-term Selangor executive councillor Ean Yong, had received kickbacks totalling thousands of ringgit from several private companies.

He was being quizzed by MACC legal director Datuk Abdul Razak Musa over the Selangor team's investigations into a complaint that DAP state lawmakers were abusing state funds.

Gobind jumped to his feet and objected strongly to the questions aimed at the witness at that point.

He wanted the court to expunge the entire testimony at first, claiming that Abdul Razak, who is holding a watching brief for the MACC in the inquest, had broken their "gentleman's agreement" to limit his questions to four accounting documents, said to be invoices printed from Teoh's laptop before he died.

But Gobind changed his stand when Abdul Razak insisted he had confined his questions to what was agreed yesterday.

Abdul Razak said the MACC investigator's testimony was relevant to show Teoh's "state of mind" and that he was not out to "bad mouth" the deceased.

But Gobind was having none of that. And neither were the lawyers for the Bar Council and Ean Yong's counsel, Salim Bashir.

"This is an inquest. My client is not on trial," Salim said loudly.

The lead lawyer for the Attorney-General's Chambers who is helping the coroner in the inquest, Tan Hock Chuan, also stood up and told the magistrate that the matter had gone "a little too far".

He advised the magistrate to take a short break and check the court notes before making his decision.

Teoh fell to his death outside the Malaysian Anti-Corrupton Commission's (MACC) office at Plaza Masalam here on July 16 after a marathon interrogation session that lasted some 10 hours.

He was due to register his marriage to his pregnant fiancée the same day. Two pathologists have concluded that he very likely committed suicide.

now, what would the idiot nazri's excuse and our police's excuse ? the "letters" mentioned macc big shot Hishammudin is involve in this case, but monday the police denied the involvement of hishamuddin as alleged in the "letters" after some investigation. But, obvious, from today's court, MACC big shot Hishammudin's involvement is confirmed, and it proved that the "letters" has a lot of truth in.

Hishammudin must be susepnd immediately while further investigation by independant body must be carried out immediately to avoid certain quarters using MACC for personal politic agenda. SHAH ALAM, Aug 25 — Anti-graft investigator Mohd Anuar Ismail told the coroner's court today that top Selangor Malaysian Anti-Corruption Commission (MACC) officials had ordered him to step up investigations into allegations that Selangor assemblymen misused public funds.

He named the senior officials as Selangor MACC deputy director Hishamuddin Hashim and investigations unit chief Hairul Ilham Hamzah.

One of them was named in a mystery letter alleging political collusion in investigating the Pakatan Rakyat state government.

Mohd Anuar, 32, is the 16th witness in the inquest into political aide Teoh Beng Hock's death on July 16 at the MACC office in Plaza Masalam here.

Gobind: Why did you need to question the witness at night?

Mohd Anuar: That's normal practice.

Gobind: Don't be silly. If I asked you to climb a tree, will you do it? I'm asking you why?

Mohd Anuar: To hasten the investigation.

Gobind: Why?

Mohd Anuar: [after hesitating] Because the issue had become sensitive.

Gobind: What issue?

Mohd Anuar: The issue on the allocation of state assemblymen. Because the newspapers were publishing it every day.

The MACC man's reply drew a snide remark from Gobind before he continued his heated interrogation of the witness.

Gobind: You were directed to bring them in and get confessions from them?

Mohd Anuar: No.

Gobind: Please! You're on oath here.

Mohd Anuar: [hesitates] Ya.

Gobind: Who directed you?

Mohd Anuar: There were two people.

Gobind: Who are they?

Mohd Anuar: The deputy director Tuan Hishamuddin Hashim and Tuan Hairul Ilham.

Gobind: Who is he?

Mohd Anuar: Head of investigations unit.

Gobind seemed satisfied that he succeeded in extracting some names from Mohd Anuar, but couldn't seem to stop from pointing out that the MACC investigator who had been asked to step up the investigations had been "sleeping all night", causing the public gallery to erupt into chuckles — even drawing a smile on the magistrate's face — and a faint protest from the witness.

MACC report lodged against five parties linked to PKFZ issue

PUTRAJAYA: PKA chairman Datuk Lee Hwa Beng revealed Wednesday the possibility of a conspiracy among five parties, including former Port Klang Authority general manager over the Port Klang Free Zone scandal.

Besides former PKA general manager Datin Paduka O.C. Phang, Lee said those involved in the conspiracy were Kuala Dimensi Sdn Bhd, its president and CEO Datuk Seri Tiong King Sing, BTA Architect and PKFZ development works consultant Bernard Tan Seng Swee.

Lee said various parties had also made disputed claims from the PKFZ project amounting to about RM1.5bil.

This was revealed in his report which he lodged with the Malaysian Anti-Corruption Agency (MACC) at the commission's headquarters here Wednesday.

SHAH ALAM: The Malaysian Anti-Corruption Commission (MACC) investigating officer in charge of the case involving Teoh Beng Hock admitted that he would not know if the political aide was threatened when he was questioned by the officers.

Mohd Anuar Ismail said this was because he had been asleep most of the time when his subordinates interrogated Teoh in the early hours of July 16.

He said this at the inquest into Teoh's death when he was cross-examined by counsel Gobind Singh Deo, who is holding a watching brief for Teoh's family.

Gobind: During your snooze, you didn't know what was going on?

Mohd Anuar: The officers briefed me.

Gobind: When you were sleeping, you didn't know whether there were threats.

Mohd Anuar: I didn't know.

Teoh, the political secretary to Selangor executive councilor Ean Yong Hian Wah had been summoned to the MACC office at the 14th floor of Plaza Masalam here on July 15 to be questioned over the alleged irregular disbursement of state allocations. He was found dead on the fifth floor the following day.

Mohd Anuar said he did not lodge a report after discovering that Teoh had died but rushed to Putrajaya to consult with his superiors.

Gobind: Your star witness is dead and you didn't make a police report but got into your car and rushed to Putrajaya? Why did you not call the police?

Mohd Anuar: The situation was panicky as there was a dead person.

Mohd Anuar, 32, also said he had been instructed to go to Putrajaya for further instructions as well as lodge a police report on July 17 by the Selangor MACC deputy director Hishamuddin Hashim.

Gobind, who wanted to know why Mohd Anuar had left Teoh's remains "lying there" without even informing the latter's family, lawyer or boss, suggested he may have done so as there was "something to hide or remove" from the scene.

"I do not agree," Mohd Anuar replied.

Earlier in the day, Anuar testified that he did not probe Teoh on his condition during the questioning session with MACC officer Mohd Nadzri Ibrahim at 2am as there was no need to do so.

However, Mohd Anuar who admitted he had gone back to sleep after inquiring if everything was alright, said he noticed that Teoh appeared to be uncomfortable and withholding something when his statement was being recorded.

Mohd Anuar added that he had asked Teoh if everything was okay but Teoh had kept mum.

Asked why he had not tried to find out why Teoh had kept silent and appeared uncomfortable, Mohd Anuar said it had not occurred to him to so.

Gobind also said Teoh's lawyer M. Manoharan had waited at the MACC office for an hour on July 15 but no one had come out to speak to him.

To this, Mohd Anuar said he was not aware that Manoharan had come to the MACC office that day.

On why the questioning had to be carried out throughout the night, Mohd Anuar replied that there was an urgency in conducting Teoh's case given the wide media coverage it had received.

Gobind asked: "You were directed to bring them in and get a confession?"

Mohd Anuar admitted that he had been instructed to do so by Hishamuddin and MACC head of investigation unit Hairul Ilham Hamzah.

Azmil ordered the police officer investigating Teoh's case, ASP Ahmad Nazri Zainal, to investigate four invoices obtained from the deceased's laptop by the Selangor MACC officers.

Azmil instructed that a statement be recorded from state Mohd Anuar concerning Teoh's cautioned statement to the MACC.

This was to ascertain the relevance of the invoices to Teoh's death.

The recommendation was made by counsel holding a watching brief for the MACC Datuk Abdul Razak Musa.

The issue that has been brought up may be a new issue for the police, said Abdul Razak.

Earlier when being cross-examined by Abdul Razak, Mohd Anuar explained that Teoh's responsibility was preparing claims for his boss Selangor executive councilor and Seri Kembangan assemblyman Ean Yong Hian Wah.

He added that the amount claimed last year and this year by Ean Yong was quite substantial.

Mohd Anuar also said his team had seized boxes of documents related to claims made by Ean Yong.

He also told the inquest that Teoh had been asked to return the following day with receipts and vouchers to support the seized documents.

Abdul Razak also wanted to tender in the documents as well as Teoh's cautioned statement to be marked as exhibits.

Abdul Razak said the cautioned statement would show the deceased's state of mind and that he was frightened to face reality and that illegal things had been done.

But Teoh's family counsel Gobind Singh Deo, who opposed the move, questioned how the statement could indicate the deceased's state of mind given that Mohd Anuar had already testified that Teoh appeared as if he had wanted to say something but had held back.

"This statement is prejudicial as the witness (Mohd Anuar) had said Teoh Beng Hock was uncomfortable.

"It is not an accurate reflection of what Teoh Beng Hock really wanted to say," said Gobind.

He said that the cautioned statement would also be prejudicial as Teoh was not there to defend himself.

Gobind's objection was supported by counsel holding a watching brief for Selangor Malik Imtiaz Sarwar.

Abdul Razak said it was necessary to bring in the cautioned statement to indicate Teoh's mental state as well as his involvement in the matter.

"We cannot rule out suicide as there is no evidence to show that he was murdered. I am surprised why they do not dare to allow this to be tendered," he added.

Meanwhile, government appointed counsel Tan Hock Chuan suggested that the statement is produced when the recording officer Mohd Nadzri Ibrahim takes the stand.

He said like the other parties, the MACC also has its own theory regarding what had happened to Teoh.

"So let them put in their theory. It can be tested," said Tan.

Gobind said if this was the case, Ean Yong should also have his lawyer present.

"It cannot be one-sided," said Gobind who later informed the inquest that he had contacted Ean Yong who said he needed some time to appoint a lawyer.

Azmil Muntapha then adjourned the inquest to Wednesday to allow time for these things to be carried out.

03:05pm: Court adjourns till tomorrow morning as coroner orders investigating officer ASP Ahmad Nazri Zainal to take down the statement from 16th witness Mohd Anuar Ismail regarding the four documents printed from Teoh's laptop and also Teoh's recorded statement made with Mohd Nadzri Ibrahim in MACC building to see whether it is relevant to Teoh's cause of death. The adjournment is also to allow Selangor executive councillor Ean Yong Hian Wah to be present with his legal counsel.

12:59pm: Teoh's fiancee Soh Cher Wei, 28, walks into the courtroom and sits at the front row of the public gallery with Teoh's family. This is the first time she sits in the public gallery. Soh is also listed as witness in the inquest.

12:45pm: To a question by Abdul Razak, Anuar says there were four quotation documents from four different companies found on Teoh's laptop.

12.35pm: Anuar says MACC team seized Teoh's laptop and CPU at his office. Teoh appeared restless.

12:30pm: Lawyer for MACC Abdul Razak begins questioning Anuar.

12.15pm: Anuar said he was instructed by Selangor MACC deputy director Hishamuddin Hashim to lodge a police report the next day after Teoh was found dead on fifth floor of Plaza Masalam on July 16.

12pm: Anuar admits to Gobind that he had given an incorrect answer during yesterday's proceedings where he said there was no threat or violence used on Teoh during interrogation. Under intense grilling today, he agrees with Gobind that he could not have known if there was threat or violence used on Teoh because he had slept off for a significant amount of time.

11:51am: Anuar agrees that Teoh "could have something to tell" despite keeping quiet when Anuar last saw Teoh at about 2am on July 16 when Anuar when to check the questioning session. At that time, Mohd Nadzri was recording Teoh's statement. Anuar walked in and asked if everything was okay to which Mohd Nadzri replied there was no problem. Teoh had kept quiet.

11:40am: Anuar tells the court that he did not probe Teoh on his condition during the questioning session with MACC officer Mohd Nadzri Ibrahim at about 2am on July 16 because there was no need to do so.

11:25am:Court resumes. Gobind continues with his questioning of Anuar.

10:25am: Gobind tells Anuar that there are police reports lodged against MACC for torture during interrogation. Anuar says he is not aware of such police reports.

10:20am: Anuar admits to Gobind that in MACC officers do go by shortnames. Mohd Anuar Ismail goes by MAI, acronym of his name. Gobind suggests that Anuar uses MAI so witnesses will not know his real name during interrogation. Anuar disagrees.

09:57am: Datuk Abdul Razak Musa, lawyer for MACC officers during the inquest, gets up to object.

09:50am: Anuar tells the court that it was normal for MACC to keep witnesses till late at night. However, he agreed to Gobind's suggestion that it was not normal to keep anyone in the office till late night on general basis.

Gobind: Why do you have to investigate until late night?

Gobind aptly questioned IO Anuar: "If you say you need to hasten it, then why did you sleep all night?" (Anuar had earlier testified that after he last saw Teoh at about 2am. He went to the surau and slept. He woke up at 5am to move to visitor's area (ruang tamu) of the MACC and slept off until 8.30am.

It is ridiculous to consider it as urgent and yet IO did not observe throughout the interrogation. What is the working hours of the MACC Officers based on employment contract and is there any 24 hours pay? If it is on shift duty, what is the official working hours schedule? Every human being needs sufficient sleep every night. So why IO on duty needs sleep but the witness does not need sleep till 3:45am??? It is an interference of personal privacy and freedom to sleep, and violation of basic human rights as Teoh was a witness and not a suspect since his hands were not handcuffed during interrogation.

to face the panel of lawyers and subject them to questioning by the
like of Gobind Singh and Karpal. Only then can the truth be
establoished. The police cannot be trusted at all. Before they begin

The only way I can believe is for his DNA to be taken in a open court
and have the DNA profiling done by an independent lab (preferably an
Australian one) in parallel with the chemistry department.

It is easy for the police and the chemist to say there is no evidence
to support a claim. But in such an important case, we would want them
to prove a claim is wrong, considering all materials are now under
their possession. That is, we want them to explain and cite proof.
Otherwise, it is easy for an incompetent investigating agency or one
that has a certain motive to mislead a court. Is that big legal
loophole now being exploited? It seems quite likely.

Somehow no one is surprised with what the police reported. But then
again why is the police investigating officer coming forward to be
cross examined? Like Gobind can ask if he made this inquiry or that or
questioned this or that person. why is Tan Hock Chuan giving evidence
of the police investigation report? That is hearsay at the very best
and it is trite that this is not allowed. And please Gobind, subpoena
Hishamudin Hasim to provide his DNA sample to our Thai pathologist
herself for testing. the result will be different. If at all it will
only rule him out as a possible killer so if he has nothing to hide
then he will cooperate. Otherwise, apply the adverse presumption rule.

No evidence to show ... hardly any surprise is it granted that he's
the TP MACC Selangor? And he had more than half a day to cover his
tracks after the murder! Well, let's hope our Deepthroats in mACC will
provide more leads. The MACC must be brought to account! Justice for

Of course no evidence. Who would want to break his own rice bowl by
telling the investigating officers all these. The polis also scare
that if they show positivity in the findings, won't MACC do the tic
for tag to the polis. Afterall the polis has never bother to cover

yep. the police can't be trusted at all. we have lost hope in the
police long time ago. the police is under the thumb of umno which
include khir toyo of course, so naturally the police investigation
will try to clear his name... just like how they on the onset give
evidence based on teoh committing suicide. i have blog before on how
we tend to believe the allegations because of the many factors that
arise.

I am not surprised that the mystery letter is unsubstantiated as the
IO who handled the case had classified it as "sudden death" and
refused to investigate the possibility of homicide. So international
DNA experts should be engaged to act as independent witnesses and the
DNA test for all MACC Officers and DD should be conducted one more

RE: BRIBERY, MISCONDUCT AND CORRUPTION OF A SENIOR OFFICER OF MACC SELANGOR

With due respect, we would like to refer to the above subject-matter.

Please be informed that we, officers of the Malaysian Anti-Corruption Commission (MACC), feel obliged to expose the misconduct and bribery of a senior officer of MACC, DEPUTY DIRECTOR (DD) MACC Selangor known as PKPj I HISHAMUDDIN BIN HASHIM, in connection with the case of TEOH BENG HOCK and another case involving the bungalow of DATO' SERI DR MOHAMAD KHIR BIN TOYO in Section 7, Shah Alam, Selangor.

2. For the kind information of YBhg Tan Sri/Dato/Tuan/Puan, the DD was directly involved in the investigations on the fraud case of the Selangor State Government's funds allocation for YB Ean (ADUN Seri Kembangan). His involvement was not just on official orders, but he has also been given instructions to his subordinates to find, with any means possible, any evidence of wrongdoing by the Selangor State Government. He acted in this manner as he had made a conspiracy with Khir Toyo to topple the state government of Selangor. As a consequence of his greed, it had resulted in the death of TEOH BENG HOCK. There arise a few suspicious questions for us, officers of the MACC Malaysia, regarding how Teoh Beng Hock could have died. We suspect of the DD's involvement in the death of Teoh Beng Hock as based on the following allegations:

i) DD had ordered all MACC officers involved in the operation that he was not directly involved in the case. In fact, he was the one who gave all the orders in this operation and other operations of MACC Selangor. In fact, he was afraid to be involved directly because this could expose his conspiracy with Khir Toyo.

ii) The chemists have discovered fingerprints and male DNA on the front side of both sides of Teoh Beng Hock's belt. Based on the knowledge of our officers of MACC Malaysia, DD has an individual style of interrogation techniques which include interrogating a suspect by holding the front of his belt, lifting him a few times while shaking him.

iii) The process of collecting DNA from Selangor MACC officers was performed in 2 sessions. In the first session of collecting DNA, DD made every effort to evade from giving his DNA sample. The DD was said to have given his DNA sample in the second session, but suspicions arise because DD gave his DNA sample in the privacy of his own office while all other MACC officers including the MACC Director have given their DNA samples in a meeting room in the presence of many other individuals. Why did the DD give his DNA sample in a secretive manner? Was the DNA provided really his DNA? We, the officers of the MACC Malaysia, felt puzzled that there was no one else in the presence of the DD when he allegedly gave his DNA sample? We recommend that the DNA Test on the DD must be done again, witnessed by a group of people who can be trusted.

iv) We have been informed that the DD had ordered his subordinates to erase/clean the fingerprints on the window that Teoh was believed to have fallen from. This proved so when the police could not find any signs of fingerprints, new or old, on the window. The question is, why did the DD order that to be done?

v) We suspect, based on information we have obtained, that the DD did not clock out with his punch-card when he left the office on 16th of July 2009, at 6:10 am. This is important because it can prove that the DD was the last person to see Teoh. The question is why he did not clock out with his punch-card as he is a person who always punches his card. For record, he is very diligent with his punch-card.

3. For the information of YBhg Tan Sir/Dato/Tuan/Puan, the DD in question is very influential in the enforcement of investigation operations around Selangor and the rest of Malaysia. In MACC Selangor, he is the most important person who decides whether a case should be prosecuted even if the power should rest in the hands of the Deputy Public Prosecutor (DPP). His decision is prompted by his personal interests and those of his co-conspirators. So, it is no surprise that he led the MACC Selangor Investigative Unit for decades, at least since the Selangor state government was under the helm of the Barisan Nasional government (Khir Toyo) until now. He was promoted ahead of schedule, from Grade 41 to Grade 54, within a period of 16 years without transfer to other positions or locations other than that of the MACC Selangor. Based on the terms of employment of MACC, any officer who has been promoted or who has worked for more than 5 years in a State should be transferred to a different location to avoid the officer being involved in local bribery. One of the reasons he was never transferred is because he was tasked to "take care of" the position of Dato' Seri Dr Khir Toyo in Selangor. As a result, Khir Toyo also "took care of" his position in Selangor as a reciprocal favour.

4. As a result of his position in MACC Selangor for these many years, he has been involved in various cases of bribery and misuse of power. Some of the incidents of bribery or misuse of power that we have investigated are as follows:

i) Closing the case of Khir Toyo connected to the approval of a road construction project, in Sekinchan measuring 20.5 km valued at RM 92.5 million to a contractor that was nearly blacklisted, Meram Holdings. According to the JKR's estimates, the road should have cost less than RM 50 million. The subcontractor that did the work on the project was Cabaran Wangsa, owned by Pua Kim An, the landlord of a house that had once been rented by Khir, while another company director, Ahmad Tarmizi Tajjeury is Khir crony that was also given 100 acres of land at a profit to him of at least RM 20 million.

ii) Possess assets that exceed his emoluments such as:
a. Own a few rental houses of which one is a two storey terrace house that was purchased at an exceptional price from Pemaju Kumpulan Lebar Daun Development Sdn Bhd, as a result of the closing of the case against the Group Executive Chairman, Dato' Noor Azman @ Noor Hizam bin Mohd Nurdin. The case was investigated by then BPR Selangor for a few years together with various other houses owned by him. To avoid public and subordinate suspicions, he lived in the Government Quarters in Kg Atap, Kuala Lumpur.

b. Own a Petronas petrol station on the left of the Federal Highway KM 8.6 - 8.7, Section 1, Federal Highway, Shah Alam, 40000 Selangor (near the Melati Roundabout, from Shah Alam to Klang bound, registered under the name of his brother. The petrol kiosk only just began operation this year (2009), part of which was built above a Chinese cemetery. He managed to get the site to build the petrol station because of his power, which was exercised during the period of Khir Toyo's government in Selangor.

c. Own several plots of land around Shah Alam, in which one of them is believed to be beside the new SACC Mall registered under the name of a wife of a Selangor MACC driver named Abdullah b Azim, a full time homemaker in her late 30s.

iii) He has been caught in close proximity with a subordinate officer, Investigator rank, named Nor Azlina bt Mustafa at the side of the Shah Alam Lake in early year 2009 by 2 police officers. He showed his identification card (MACC) and informed the police officers that he and the officer were in the course of an operation and they were released. These "intimacies" between him and the Investigator were repeated and are a common knowledge of many including his own wife. The only action taken by the Department was to transfer the officer involved to the MACC Headquarters in Putrajaya. This was ineffective because Azlina is still always with the DD at the Selangor office.

5. The objective of this letter is to uphold justice and prevent the further abuse of power especially in the MACC and throughout Malaysia. We in the MACC, are fed up to see his antics which have the blessings of the powers that be, like the sayings "beraja di mata, bersultan di hati". We in the MACC have lost all means to find departments/institutions/NGOs that can champion this issue so the appropriate action can be taken.

6. We, the officers of the MACC, would be touched and thankful that YBhg Dato'/tuan/puan could expose this issue to the people and the authorities so that an organisation/NGO can take the appropriate action, or an independent investigation, can be taken and raised to the Cabinet. This is very important because it involves the integrity of a serving officer of a department that upholds the laws involving human integrity. The DD is now making every effort to press his subordinates to find any faults involving ruling PKR with the hope that the PKR-led government will fall in Selangor and his secret will be safe. For your information, the DD is now very afraid whenever news about Dato' Seri Khir Toyo is released in the press and he would be very afraid if the case would expose his involvement.

7. We hope that any brave individuals or organizations can spread this information so that our actions can be brought to the attention of the responsible and trusted authorities and that justice can be done. We are unable to do it ourselves because he has "cable" with the higher authority.

8. Cooperation from YBhg Tan Sri/Dato'/tuan/puan is much appreciated and we hope that through your action, much more information can be brought to light involving individuals with no integrity. We hope that this will cleanse the MACC and its officers from further involvement in bribery and corruption.

On 20-8-2009 Mystery Letter reveals top MACC man in political collusion. The letter which emerged at the Teoh Beng Hock inquest yesterday is believed to contain claims connecting a Top Ranking MACC Officer to the interrogation of the political aide, which could have led to his death.

The letter purportedly came from Pegawai-Pegawai MACC (SPRM) Headquarters in Putrajaya alleging Deputy Director MACC Selangor, Hishamuddin Bin Hashim and ex-Selangor Menteri Besar Khir Toyo's Secret Plot to Topple PKR Selangor State Government.

"And it was on this understanding that Teoh was called up for questioning.

The unsigned letter, which carried the MACC official letterhead and written in Bahasa Malaysia, also stated the top officer's modus of interrogation - which involves pulling the suspects by the belt.

It further alleged that the top official was questioning Teoh on the day the DAP man was found dead. However the letter did not state on how Teoh died or if the officer was directly involved in his death.

Further claims made in the letter include:

* The officer did not punch out from work when he left Plaza Masalam where the Selangor MACC is located on that day. However, the letter stated the time of him leaving the office.This is important as it could show that this officer was the last person to have seen Toeh on that day, alleged the letter.

* The officer did not provide his DNA samples along with his other colleagues. He only gave a sample privately at a later day.

* That he ordered his officers to wipe clean the window from where Teoh had apparently fallen from.

* His alleged corrupt practices while investigating previous cases and that he is generally corrupt.

* He had helped close an investigation on the politician.

The letter also stated that the top officer had been serving in the state for a long time, well beyond the usual five-year term for high ranking officials.

The letter also claimed that he was living beyond his means by having several houses, a petrol station in Shah Alam and several plots of land, courtesy of the politician's goodwill.

He was also allegedly caught for khalwat with his junior officer at the Shah Alam lake early this year.

When contacted, the politician denied all the claims made in the letter and said he will be lodging a police report as soon as he is back from his overseas trip. The MACC officer could not be contacted.

Lawyers remain tight-lipped

Yesterday, lawyer Gobind Singh Deo submitted the letter to coroner Azmil Muntapha Abas, asking him to adjourn the inquest pending an investigation into the contents of the letter.

Gobind said that he was handed the letter by an individual on Tuesday evening.

Azmil, who agreed to instruct the police to probe the letter, had then urged all lawyers involved in the case not to reveal the details of the letter to anyone. However he had not ordered a gag order on the matter.

Lawyers involved in the matter when contacted by Malaysiakinitoday remained tight-lipped on the content of the letter.

However, it is learnt that the letter was also sent out to several other people since last week, including some members of parliament.

One MP who spoke to Malaysiakini said that he received the letter last week and confirmed the contents of the letter.

"Some big names were mentioned in the letter and the claims are massive. If they are true, some very big people from Selangor MACC and the political circle will have to pay the price," he said, requesting anonymity.

The MP also said that the letter appeared to be "an inside job from MACC".

He added that the letterhead used was from the MACC's headquarters in Putrajaya.

Teoh was found dead, with his belt snapped, at the fifth floor landing of Plaza Masalam on July 16, a day after he was summoned by the MACC for questioning in regards to their probe into an alleged misappropriation of state allocation funds. He was questioned at the 14th floor.

The inquest is being held to determine how he died. It will continue on Monday pending the investigation into the letter.

"Today the Inquest in Shah Alam heard from lawyer Tan Hock Chuan that Police have 102 DNA samples from MACC officers, Police officers and others involved from investigating into the Teoh Beng Hock death. Tan told the Court that different people's DNA was found on Teoh Beng Hock's belt and jacket.

On his jacket there was DNA from two people, one of which is Teoh himself and the other is from an unknown male. On Teoh's belt, Police found DNA from three people, only one is from Teoh. This means two other people touched Teoh's belt also.

Police have asked for DNA sample from Tan Boon Hwa and Lee Wye Wing. Both these people have refused to give their DNA sample.

The Police must arrest Tan Boon Hwa and Lee Wye Wing for the murder of Teoh Beng Hock. Ronnie Liu and the DAP is also involved in the death of Teoh Beng Hock. This is a case of Chinese underworld society killing Chinese.

But to blame on the Chinese underworld is the works of BN or supporters for MACC. So this t4tbh blog is managed by people who works for BN and not for the justice of TBH. Samples taken from Tan and Lee do not match those on Teoh

SHAH ALAM: The DNA samples taken from two "reluctant" witnesses did not match those swabbed from the clothing of political aide Teoh Beng Hock, an inquest into his death heard.

This was revealed by lawyer Gobind Singh Deo, who is holding a watching brief for Teoh's family, who made the announcement at the start of the proceedings yesterday.

Last Wednesday, when the inquest was scheduled to start, lawyer Tan Hock Chuan, appointed by the Government to assist coroner Azmil Muntapha Abas, said that two witnesses — Kajang councillor Tan Boon Hwa and one Lee Wye Wing — had refused to give their DNA samples for tests.

However, both Tan and Lee submitted their DNA samples last week and clarified that they had not refused to do so.

This means that the mystery DNA found on Teoh — as revealed last week — remains unsolved for now.

(CBS) Scientists in Israel have successfully fabricated blood and saliva samples containing DNA, potentially undercutting what has been considered key evidence in the conviction or exoneration in crime cases, the New York Times reported.

According to the newspaper, the scientists also demonstrated that if they had access to a DNA profile in a database, they could construct a sample of DNA to match that profile without obtaining any tissue from that person.

"Any biology undergraduate could perform this," said Dr. Dan Frumkin, lead author of the paper, which is published online in the journal Genetics.

The paper asserts that while DNA analysis has become a centerpiece of law enforcement, the possibility that such evidence can be faked has not been considered.

"This is potentially huge news in the world of criminal justice, which hasn't yet even fully had the time to embrace DNA for all of its uses," said CBS News legal analyst Andrew Cohen. "And I suspect it won't be long before defense attorneys are using this study to undercut DNA analysis and conclusions in cases all over the country."

"This is potentially terrible news for prosecutors and police and the military and all sorts of industries that use DNA testing to confirm or find information," Cohen adds. "As the paper's author says, 'You can now just engineer a crime scene.' Good news for crime dramas on television but not so much to the criminal justice system."

"It'll be interesting to see how the legal world reacts to it and whether this study will be embraced or scorned by DNA experts here in the States," Cohen said. "But you can be sure that before too long DNA evidence in criminal cases all over will be challenged based upon these findings."

3.25pm: Gobind says matters raised in the letter clearly relate to material facts and circumstances relevant to the inquest.

He says he is making an application to the court for the letter to be investigated and has informed Teoh's family accordingly.

Tan Hock Chuan, for the Attorney-General's Chambers, said the prosecution has no objection for further investigation to be carried out. "All of us are interested to know the truth. These are allegations that must be investigated by police. Let the police investigate to verify the truth or otherwise of the allegations."

It is learnt that the coroner and all interested parties viewed the letter earlier in the afternoon.

3.20pm: Gobind said a letter was handed to him after yesterday's proceedings. He said the letter contained explicit details which are of significance to the inquest.

3.15pm: Gobind Singh Deo says Teoh's family is in the court. He said there is a new development to the case.
